AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Ardent Mills to obtain a minor air emission construction permit for a malt mill at 2900 “C” St, Omaha.  The potential emissions, in tons, for this project will be: PM 14.0, PM10 6.8 and PM2.5 1.1.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from January 17, 2018 to February 17, 2018. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position.  The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.  Comments should be mailed to:

ORDINANCE NO. 41366

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located southwest of 222nd Street and West Maple Road from CC-Community Commercial District to CC-Community Commercial District (property is also located within the FF-Flood Fringe Overlay District). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. AN ORDINANCE to amend the boundaries of the MCC-Major Commercial Corridor Overlay District, to incorporate into that district the property located southwest of 222nd Street and West Maple Road; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. In accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lot 1, Elkhorn River Preserve, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is incorporated into the MCC-Major Commercial Corridor Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance. Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 41365

AN ORDINANCE to approve a Major Amendment to the Mixed Use District Development Agreement for West Dodge Hills, located southwest of 180th Street and West Dodge Road, between the City of Omaha and West Dundee Development Company, providing site development standards; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha, in the interest of maintaining public health safety, and welfare, desires to assure that the property located southwest of 180th Street and West Dodge Road is developed in accordance with the provisions of the Major Amendment to a Mixed Use Development Agreement attached hereto and made a part hereof by reference. Section 2. That if this Ordinance, or portion thereof, is found to be invalid, any zoning ordinance applicable to such site shall not be invalidated for such reason. Section 3. That this Major Amendment to a Mixed Use Development Agreement is hereby approved. Section 4. That this Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

ORDINANCE NO. 41371

AN ORDINANCE to create Street Improvement District No. 6883, in the City of Omaha, for the purpose of improving Woolworth Avenue from South 80th Street to Ridgewood Avenue by grading, curbing, addressing storm sewerage and paving in Portland cement concrete; to fix and define the boundaries of said district; to provide for the determination and assessment of damages, if any, occasioned by reason of change of grade; to authorize the Public Works Department, barring protest to the contrary in accordance with OMC 26-65, to complete the associated improvement project; and to provide for an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That Street Improvement District No. 6883 is hereby created in the City of Omaha for the improvement of: Woolworth Avenue from South 80th Street to Ridgewood Avenue. This improvement, as petitioned by the residents, includes grading, curbing, storm sewerage and paving, and is to be completed in Portland Cement Concrete. Section 2. That Street Improvement District No. 6883, shall comprise Woolworth Avenue from South 80th Street to Ridgewood Avenue, and shall include: Lot 4, Block 2; the South 80' and the East 80' of the North 60' of Lot 5 together with the East 80' of the South 20' of Lot 6; Lot 1, Block 3; and Lot 9, Block 3, Loveland Addition, located in the Northwest Quarter of the Northwest Quarter and the Southwest Quarter of the Northwest Quarter Section 26-15-12. The outer boundary of said District shall be the outer boundary of the lots hereinabove set forth. Section 3 That if this project shall include a change of grade, then a committee of three freeholders shall be appointed to assess, determine and report to the City Council the damages, if any, to property owners which may be caused by grading or change of grade, if any, in said District, taking into consideration in making such appraisement, the benefits accruing by virtue of the entire improvement contemplated and set forth in this Ordinance. If any damages may be found to have accrued to any property affected, such damages may upon finding of special benefits, be assessed against the properties in the District so benefited. Section 4. That the Public Works Department is authorized to create the design for the improvements, prepare an engineer's estimate, solicit bids and carry out other associated required actions, to complete the project for this improvement District in accordance with the Omaha Municipal Code. Section 5. That this Ordinance, being administrative in nature, shall take effect and be in full force upon the date of its passage.

ORDINANCE NO. 41370

AN ORDINANCE approving an Agreement for the sale of City-owned real property; to provide that notwithstanding any provisions of the Omaha Municipal Code to the contrary, the City is authorized to enter into the attached Real Estate Purchase Agreement with George Gumise, 2732 Fontenelle Blvd, Omaha, NE 68104, to convey the property described in the attached agreement, located at 4346 Lake Street, in consideration of the sum of One and 00/100 Dollars ($1. 00); there are no expenses associated with the transfer of the property to George Gumise; and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Notwithstanding any portion of the Omaha Municipal Code to the contrary, the attached Real Estate Purchase Agreement with George Gumise is hereby approved and the Mayor is hereby authorized to execute, and the City Clerk to attest, any documents necessary or appropriate to convey the property described in the attached agreement, in consideration of the sum of One and 00/100 Dollars ($1 .00). There are no expenses associated with the transfer of the property to George Gumise. Section 2. Upon completion of the conditions in the attached Agreement, the Mayor of the City of Omaha is hereby authorized and empowered to execute a Warranty Deed to said property, and the City Clerk to attest the same, to George Gumise. Section 3. That this Ordinance, not being legislative in character, shall take effect upon the date of its passage in accord with Section 2.12 of the Omaha Municipal Code.

AN ORDINANCE to approve an agreement between the Omaha Convention and Visitors Bureau and Simpleview, Inc. for three (3) years, January 1, 2018 through December 31, 2020, with the option to extend for an additional three (3) years, for tourism specific content management, sales solution, and hosting with an ongoing agreement with the Omaha Convention and Visitors Bureau to host the Visit Omaha's website in an amount not to exceed $750,000.00 for the three-year period; to authorize the payments specified therein; and, to provide an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the attached agreement between the Omaha Convention and Visitors Bureau and Simpleview, Inc., for three (3) years, with the option to extend for an additional three (3) years, for tourism specific content management, sales solution, and hosting with an ongoing agreement with the Omaha Convention and Visitors Bureau to host the Visit Omaha's website be granted in an amount not to exceed $750,000.00 for the three-year period. Section 2. That the Finance Director of the City of Omaha is authorized to provide payment not to exceed $750,000.00 for the three-year period from Fund 21109 - Omaha Convention and Visitors Bureau, Organization No. 115911 - Admin, Account No. 42266 – Information Technology Contracted Services, Project Code 0123 - DOTcomm. Section 3. That the funding of this contract will come from the existing Omaha Convention and Visitors Bureau's budget, which is primarily funded through the hotel lodging tax paid by out of town visitors. Section 4. That this Ordinance, not being of legislative character, shall be in force and take effect immediately upon its date of passage.

AN ORDINANCE to approve the acceptance of and authorize the disbursement from the FY 2017 State Homeland Security Grant (SHSG) Award #EMW-2017-SS-00020-S01, and budget in the amount of four hundred and forty-three thousand, nine-hundred and fifty dollars ($443,950) from the Nebraska Emergency Management Agency (NEMA), during the award period of September 1, 2017 through June 1, 2020, to provide first responder and emergency management agencies in Douglas, Sarpy, and Washington Counties with enhanced capabilities to prevent, protect against, mitigate, respond to, and recover from manmade threats and natural disasters; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, the acceptance of and disbursement from the FY 2017 State Homeland Security Grant (SHSG), Award #EMW-2017-SS-00020-S01, and the budget in the amount of four hundred and forty-three thousand, nine-hundred and fifty dollars ($443,950) from the Nebraska Emergency Management Agency, during the award period of September 1, 2017 through June 1, 2020, to provide first responder and emergency management agencies in Douglas, Sarpy, and Washington Counties with enhanced capabilities to prevent, protect against, mitigate, respond to, and recover from manmade threats and natural disasters is hereby approved. That this ordinance being administrative, and not legislative, in character shall be in full force and take effect immediately upon passage.

ORDINANCE NO. 41369

AN ORDINANCE to approve an Amendment to the Land Use Element of the Master Plan for the City of Omaha, to change the future land designation from open space to low-density residential for the property generally described as 9300 Arbor Street; and to provide for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Section 7.05 of the Charter of the City of Omaha allows for the City Council to adopt amendments to the City's Master Plan as deemed necessary and appropriate upon recommendation by the Planning Board. Section 2. The Planning Board, at their November 1, 2017 public hearing, recommended approval of the proposed amendment to the Land Use Element of the City's Master Plan to change the future land designation from open space to low-density residential for the property generally described as 9300 Arbor Street, as provided for on Exhibit "A" attached hereto and made a part hereof by this reference. Section 3. The said proposed amendment to the City's Master Plan, as set forth in the attached Exhibit "A", is hereby approved. Section 4. That this Ordinance shall be in full force and effective fifteen (15) days from the date of its passage.
