AN ORDINANCE to amend the boundaries of the MCC – Major Commercial Corridor Overlay District, to incorporate into that district the property located south of 66th Circle and L Street.

SUMMARY:

In accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that:

AN ORDINANCE authorizing the issuance of a purchase order to Interstate PowerSystems for a price agreement for predictive/preventative maintenance services and inspection, maintenance and repair of plant engines and related equipment at the Missouri River Wastewater Treatment Plant and Papillion Creek Wastewater Treatment Plant in the amount of $538,900.00. The price agreement will be effective for an initial period of 12 months and renewable for four separate one year periods; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from a specific account; and, to provide an effective date hereof.

ORDINANCE NO. 41304

AN ORDINANCE vacating a portion of the 132nd Street right-of-way abutting a parcel commonly known as 333 South 132nd Street and legally described in the attached Exhibit "A"; and providing the effective date hereof.

WHEREAS, a petition representing owners of more than 75 percent of the property abutting that portion of 132nd Street, as described above, has been filed with the City of Omaha; and,

WHEREAS, said property owners have in and by said petition waived any and all damages that may be occasioned by said vacation.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:

Section 1. That a portion of the 132nd Street right-of-way abutting a parcel commonly known as 333 South 132nd Street and legally described in the attached Exhibit "A" (THAT PART OF THE 132ND STREET RIGHT OF WAY IN THE SW 1 / 4 OF THE NW 1 / 4 OF SECTION 19, T15N, R12E OF THE 6TH P.M., DOUGLAS COUNTY, NEBRASKA); be, and hereby is, vacated and without further act of the City, title to the vacated right-of-way shall pass to the abutting owner of said property thereof; the vacating of the property herein described, and the reversion thereof, pursuant to applicable law, shall be subject to the conditions and limitation that there is reserved to the City of Omaha the right to maintain, operate, repair and renew sewers now existing therein and in the future to construct, maintain, repair and renew additional or other sewers; and also the right to authorize the public utilities and cable television systems to construct, maintain, repair or renew and operate now or hereafter installed water mains and gas mains, pole lines, conduits, electrical transmission lines, sound and signal transmission lines and other similar services and equipment and appurtenances above, on and below the surface of the ground for the purpose of serving the general public or abutting property; and the right so reserved shall also include such lateral connection or branch lines as may be ordered, desired or permitted by the City or such other utility and to enter upon the premises to accomplish the above purposes at any and all times. No buildings, improvements, or other structures shall be placed in, on, over, or across said vacated right-of-way without express written approval of the City. All vegetation upon the premises, including but not limited to, trees, bushes, and crops, and all structures upon the premises, including but not limited to, buildings, walls, fences, drives and walks, may be damaged or removed as necessary in the exercise of the rights herein reserved without compensation to any person.

Section 2. That the abutting property owner shall install a turnaround hammerhead at the southern end of the 132nd Street frontage road (immediately north of the vacated right-of-way) and dedicate a permanent public access easement to allow for the maintenance of traffic signal detection equipment in the vacated right-of-way.

Section 3. That this Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

AN ORDINANCE approving a redevelopment and tax increment financing loan agreement between the City of Omaha, a Nebraska Municipal Corporation in Douglas County, Nebraska, and Sorensen Heights, LLC, a Nebraska limited liability company, to implement the Sorensen Heights Senior Housing Tax Increment Financing (TIF) Redevelopment Project Plan for a project site located at 6657 North 56th Street, which proposes a multi-family senior housing development consisting of 75 two bedroom units, of which 67 will be for tenants at or below 60 percent AMI (Area Median Income) and 8 units will be market rate rentals; the agreement authorizes the use of up to $500,000.00 in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project; and, providing for an effective date.

AN ORDINANCE levying a special assessment for fees and civil penalties in accordance with Chapter 48, Article I, Division 15, the City of Omaha Vacant and Abandoned Property Ordinance of the Omaha Municipal Code on certain lots in the City of Omaha, Group No: 2017-01.

WHEREAS, it having been and being hereby adjudged, determined and established that several lots and pieces of real estate, hereinafter referred to have been inspected and registered as required by Chapter 48, Article I, Division 15 of the Omaha Municipal Code for the full amount herein levied and assessed against each of said lots and pieces of real estate respectively, by the City of Omaha.

AN ORDINANCE to approve the acceptance of and authorize disbursement over more than one fiscal year from the FY 2016 Assistance to Firefighters (AFG) Grant Program -Fire Prevention and Safety, Award #EMW-2016-FP-00807, in the amount of one hundred eighty-nine thousand six hundred and twenty dollars ($189,620), a match of nine thousand four hundred and eighty dollars ($9,480) provided by the Omaha Fire Department from Fund 12168, Organization 130625, and total program budget in the amount of one hundred ninety-nine thousand one hundred dollars ($199,100), during the project period of August 11, 2017 to August 10, 2019; to provide funding for one (1) full­time Community Fire Safety Education Specialist position focused on North Omaha, smoke and carbon monoxide (CO) tamper-resistant detectors, and promotional materials for the Omaha Fire Department's Public Education Division as detailed in the attached grant application; to authorize payment from such grant funding and involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date thereof.
