NOTICE TO PUBLIC
The City Council of the City of Omaha will have a pre-Council meeting at 10:30 a.m. in the Conference Room, LC1, Omaha/Douglas Civic Center, 1819 Farnam Street, for the purpose of discussing the agenda items and briefing and discussion of public business, and a regular Council Meeting at 2:00 p.m. on Tuesday, June 13, 2017, in the Legislative Chambers of the Omaha/Douglas Civic Center in Omaha, Nebraska.  Proposed agenda kept continually current shall be available for public inspection in the Omaha/Douglas Civic Center at the Office of the City Clerk, but the Council shall have the right to modify the agenda to include items of an emergency nature only at such public meeting when convened.

“NOTICE TO PUBLIC”
The following Ordinance has been set for City Council Hearing on June 13, 2017, at 2:00 P.M.:
AN ORDINANCE vacating a portion of the east/west alley adjacent to South 31st Street between Mason and Marcy Streets extending 100 feet to the west of a previously vacated portion of said alley and abutting Lots 4-5, Block 0, Clifton Place and Lots 4-5, Block 0, Housel & Stebbins Subdivision Lot 14, as surveyed, platted and recorded in Douglas County, Nebraska lying in the Southwest 1/4 of Section 21, Township 15, Range 13; providing for the reversion or transfer of the same; and, providing the effective date hereof.
WHEREAS, Neb. Rev. Stat. Section 14-375 provides that the City Council may vacate a street or alley without petition upon City Planning Board recommendation; and,
WHEREAS, the Statute further provides that a Committee of Appraisers be appointed to appraise damages, if any, to property affected by the vacation; and,
WHEREAS, Resolution No. 846 adopted July 14, 2015, appointed Pete Festersen, Chris Jerram, and Aimee Melton, members of the City Council, to assess damages to all property affected by the vacation; and,
WHEREAS, on May 2, 2017, the Committee of Appraisers held a meeting immediately following the 10:30 A.M. staff meeting in the Council Conference Room, at which meeting no cause for any damages was found as a result of the vacation; and,
WHEREAS, the City Council finds there are no damages as a result of this vacation, and that such vacation should be approved.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. That a portion of the east/west alley adjacent to South 31st Street between Mason and Marcy Streets extending 100 feet to the west of a previously vacated portion of said alley and abutting Lots 4-5, Block 0, Clifton Place and Lots 4-5, Block 0, Housel & Stebbins Subdivision Lot 14, as surveyed, platted and recorded in Douglas County, Nebraska lying in the Southwest 1/4 of Section 21, Township 15, Range 13 be, and hereby is, vacated and without further act of the City, the vacating of the property herein described, and the reversion or transfer thereof under this ordinance, pursuant to applicable law, shall be subject to the conditions and limitation that there is reserved to the City of Omaha the right to maintain, operate, repair and renew sewers now existing therein and in the future to construct, maintain, repair and renew additional or other sewers; and also the right to authorize the public utilities and cable television systems to construct, maintain, repair or renew and operate now or hereafter installed water mains and gas mains, pole lines, conduits, electrical transmission lines, sound and signal transmission lines and other similar services and equipment and appurtenances above, on and below the surface of the ground for the purpose of serving the general public or abutting property; and the right so reserved shall also include such lateral connection or branch lines as may be ordered, desired or permitted by the City or such other utility and to enter upon the premises to accomplish the above purposes at any and all times. No buildings, improvements, or other structures shall be placed in, on, over, or across said vacated right-of-way without express written approval of the City. All vegetation upon the premises, including but not limited to, trees, bushes, and crops, and all structures upon the premises, including but not limited to, buildings, walls, fences, drives and walks, may be damaged or removed as necessary in the exercise of the rights herein reserved without compensation to any person.
Section 2. That the City hereby conveys and transfers the aforesaid vacated property to Uptown Properties, LLC, subject to the rights and duties specified in this ordinance.
Section 3. That Uptown Properties, LLC must dedicate a permanent public access easement throughout the vacated area, must execute a damage waiver for the continuation of waste collection services, and must abide by the conditions of the subdivision agreement for this area.
Section 4. That this Ordinance shall be in full force and take effect fifteen (15) days from and after the date of its passage.

AN ORDINANCE to amend Section 23 - 177 of the Omaha Municipal Code concerning employment classifications by adding the employment classifications entitled Traffic Signal Supervisor I with a salary range of 14.1 MC ($54,016.00-$65,287.00) and Traffic Signal Supervisor II with a salary range of 15.2 MC ($55,531.00-$67,871.00); to repeal Section 23 - 177 as heretofore existing; and, to provide the effective date hereof.

AN ORDINANCE to approve an agreement between the City of Omaha and the Women's Center for Advancement in the amount of one hundred sixty-three thousand, nine hundred ninety-four dollars ($163,994.00); to authorize funding for such agreement from the City of Omaha's FY 2016 Improving Criminal Justice Reponses to Sexual Assault, Domestic Violence and Stalking Grant Program (ICJR), Award #2016-WE-AX-0041, awarded by the Office on Violence Against Women (OVW); to provide funding of one (1) full-time Victim Advocate and one (1) part-time Victim Advocate; involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof.

AN ORDINANCE to approve an agreement between the City of Omaha and the Douglas County Board of Commissioners, Douglas County Administrative Office in the amount of one hundred ninety-two thousand, two hundred seventy-four dollars ($192,274.00); to authorize funding for such agreement from the City of Omaha's FY 2016 Edward Byrne Memorial Justice Assistance Grant (JAG) Program, Award #2016-DJ-BX-0918, awarded by the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance; to provide funding for law enforcement equipment, corrections chemical dependency evaluations, prosecutor programs, and technology improvements and training; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof.

“NOTICE TO PUBLIC”
The following Ordinance has been set for City Council Hearing on June 13, 2017, at 2:00 P.M.:
AN ORDINANCE approving a redevelopment and tax increment financing loan agreement between the City of Omaha, a Nebraska Municipal Corporation in Douglas County, Nebraska, and Vecino Natural Bridge, LLC, a Missouri limited liability company, to implement the Muse Tax Increment Financing (TIF) Redevelopment Project Plan for a project site located northeast of 20th and Izard Streets, which proposes a newly constructed 4-story, approximately 195,440 square foot multi-family, student housing structure consisting of approximately 239 units, approximately 5,000 square feet of commercial space, and approximately 278 parking stalls; the agreement authorizes the use of up to $5,406,684.00 in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project; and, providing for an effective date.

“NOTICE TO PUBLIC”
The following Ordinance has been set for City Council Hearing on June 13, 2017, at 2:00 P.M.:
AN ORDINANCE declaring the necessity of appropriating, for the use of the City of Omaha, certain hereinafter described property located at 1414, 1418 and 1424 Sherwood Avenue, 1725 Lake Street and 2629 North 15th Street, and legally described in the attached purchase agreement, for subsequent use as a site for implementing the Consolidated Submission for Community Planning and Development Programs FY 2015 Action Plan; provided that as to each specified parcel, proceedings in eminent domain may be undertaken and completed for the purpose of clearing title; to provide that notwithstanding any provisions of the Omaha Municipal Code to the contrary, the attached Agreement between the City of Omaha and Sandra Brunken, P.O. Box 1001, Frederick, Maryland 21702, and Kathy Turner, 2503 North 16th Street, Apartment 8, Omaha, Nebraska 68110, to acquire the property for the sum of thirty-one thousand, five hundred ninety-five and No/100 Dollars ($31,595.00) is approved; project costs will be paid from Community Development Block Grant, Fund 12186, Organization No. 128072, Project No. 4793, Task 10.1497, Award 100276; and, to provide the effective date hereof.

AN ORDINANCE declaring the necessity of appropriating, for the use of the City of Omaha, certain hereinafter described property located within the North Revitalization Strategy Area, and legally described in the attached donation agreement, for subsequent use as a site for implementing the Consolidated Submission for Community Planning and Development Programs FY 2016 Action Plan; provided that as to each specified parcel, proceedings in eminent domain may be undertaken and completed for the purpose of clearing title; to provide that notwithstanding any provisions of the Omaha Municipal Code to the contrary, the attached Agreement between the City of Omaha and Dan Brewer, Managing Member of Habitat for Humanity of Omaha, Inc., 1701 North 24th Street, Omaha, Nebraska 68110, to acquire the property by donation is approved; and, to provide the effective date hereof.
