ORDINANCE NO. 41737
AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located southeast of 168th Street and Military Road from AG-Agricultural District to DR-Development Reserve District. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. ORDINANCE NO. 41716
AN ORDINANCE to amend the boundaries of the ACI-2 Area of Civic Importance Overlay District, to incorporate into that district the properties located at 5003 Dodge Street and 106 South 50th Street; and to provide an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. In accordance with Sections 55-609 through 55-617 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lots 1-3, with the exception of the north 5.5 feet of Lot 1, Block 127, Dundee Place, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned to be included in and incorporated into the ACl-2 Area of Civic Importance Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance. ORDINANCE NO. 41717
AN ORDINANCE to approve an Amendment to the Future Land Use Element of the City's Master Plan from Low density residential to Office/commercial for the property located at 106 South 50th Street, and to change the boundary of the Dodge Street and Saddle Creek Road Mixed Use Area; and to provide for an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Section 7.05 of the Charter of the City of Omaha allows for the City Council to adopt amendments to the City's Master Plan as deemed necessary and appropriate upon recommendation by the Planning Board. Section 2. The Planning Board, at their November 7, 2018 public hearing, recommend DENIAL of the proposed amendment to the Future Land Use Element of the City's Master Plan from Low density residential to Office/commercial for the property located at 106 South 50th Street, and to change the boundary of the Dodge Street and Saddle Creek Road Mixed Use Area, as provided for on Exhibit "A" attached hereto and made a part of this reference. Section 3. The said proposed amendment to the City's Master Plan, as set forth in the attached Exhibit "A", is hereby approved. Section 4. That this ordinance shall be in full force and effective fifteen (15) days form the date of its passage.

ORDINANCE NO. 41739
AN ORDINANCE to exercise the prior option to extend a contract by two years, to be effective from March 1, 2019 through February 28, 2021, initially approved by the City Council by Ordinance No. 39947, with Deffenbaugh Disposal Service, Inc. for the collections of solid waste from Omaha Housing Authority sites in an estimated amount of $76,340.00 annually for a two-year sum of $152,680.00; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from specific accounts; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City Council of the City of Omaha hereby approves the first of two optional two-year extensions of the contract with Deffenbaugh Disposal Service, Inc. for the collections of solid waste from Omaha Housing Authority sites, to be effective from March 1, 2019 through February 28, 2021. Section 2. That payment for this contract extension, involving appropriations of more than one year, is authorized in accord with Section 5.17 of the Home Rule Charter of 1956, as amended. Section 3. That the Finance Department is authorized to pay the cost of this contract extension according to actual use, in an estimated amount of $76,340.00 annually from the General Fund 11111, Solid Waste Collection and Disposal Organization 116321. Section 4. That this Ordinance, being administrative in nature, shall take effect and be in full force upon the date of its passage.

ORDINANCE NO. 41741
AN ORDINANCE declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of constructing the 72nd & Maple Street Intersection Safety project identified as OPW 52937; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings be undertaken and completed; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That it is proper and necessary and it is hereby declared proper and necessary to appropriate certain private property for the purpose of constructing the 72nd & Maple Street Intersection Safety project identified as OPW 52937; Said property and lands necessary for such purposes are described as follows: See the attached Exhibit "A" plat drawing of abutting properties for which land acquisitions, permanent easements and temporary construction easements will be needed to complete this project. Section 2. That the Public Works Department of the City of Omaha be, and it hereby is, authorized, empowered, and directed to negotiate, through either employees of the City of Omaha or through persons employed therefor or through any combination thereof, with the owners of the above-described properties for the acquisition of said properties by the City of Omaha for aforesaid purposes. Upon failure to agree by negotiations with the owners of any of the above-described properties for the acquisition thereof by the City of Omaha, the Public Works Department is authorized, empowered, and directed, together with the Law Department of the City of Omaha, to proceed forthwith to acquire any such property, not obtained by negotiation, for the City of Omaha for the aforesaid purposes by condemnation proceedings in accordance with the Laws of the State of Nebraska under the power of eminent domain. Any notices in the name of the City of Omaha required to be given the owners or other persons having any interest in and to any of the above described real estate may be given by either the Public Works Department or the Law Department of the City of Omaha. The Public Works Department will be responsible for recording of all deeds, easements or other acquisition documents resulting from the exercise of the authority granted under this Ordinance in the Register of Deeds Office in the appropriate county. Section 3. That this Ordinance shall take effect and be in force after its passage.

AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and 1701, LLC, a Nebraska limited liability company, to implement the Habitat Kountze Park 5 Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located between Sahler and Evans Streets and between North 18th and 24th Streets, which proposes the construction of 22 new single family homes, and rehabilitation of two existing homes; the agreement authorizes the use of up to $405,000.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Redevelopment Agreement between the City of Omaha and 1701, LLC, a Nebraska limited liability company to authorize the use of up to $405,000.00, plus accrued interest, to offset TIF eligible costs such as acquisition, demolition, environmental and geotechnical studies, site work, architectural and engineering fees, and public improvements as required, for a project with total estimated costs of $5,356,900.00; including any other documents in connection with the Redevelopment Agreement necessary or appropriate to consummate the loan. Section 2. AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Westchester Capital, LLC, a Nebraska limited liability company, to implement the Elliott Equipment Company Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 3514 South 25th Street, which proposes the renovation of two existing buildings, one containing approximately 42,000 square feet building and another containing approximately 167,000 square feet, for relocation and consolidation of Elliott Equipment Company operations to a single site; the agreement authorizes the use of up to $1,131,408.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Redevelopment Agreement between the City of Omaha and Westchester Investments, LLC, a Nebraska limited liability company, c/o Elliott Equipment Company, to authorize the use of up to $1,131,408.00, plus accrued interest, to offset TIF eligible costs such as acquisition, environmental and geotechnical studies, site work, architectural and engineering fees, and public improvements as required, for a project with total estimated costs of $13,750,392.00; including any other documents in connection with the Redevelopment Agreement necessary or appropriate to consummate the loan. AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Avanti Group, LLC, a Nebraska limited liability company, to implement the Little Italy on Pierce Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 925 Pierce Street, which proposes the construction of a five-level apartment building with 83 studio, one and two bedroom apartment units with amenities, an underground parking garage with 59 parking stalls, 22 onsite parking stalls, and 16 parking stalls in the public rights of way along 10th Street and Pierce Street; and the agreement authorizes the use of up to $2,300,000.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA; Section 1. The Mayor is hereby authorized to execute, and the City Clerk to attest, the attached Redevelopment Agreement between the City of Omaha and Avanti Group, LLC, a Nebraska limited liability company, to authorize the use of up to $2,300,000.00, plus accrued interest, to offset TIF eligible costs such as acquisition, environmental and geotechnical studies, special geopier foundations, architectural and engineering fees, alley improvements, and public improvements as required, for a project with total estimated costs of $15,386,610.00; including any other documents in connection with the Redevelopment Agreement necessary or appropriate to consummate the loan. ORDINANCE NO. 41746
AN ORDINANCE authorizing the approval of the Agreement between the City of Omaha, Nebraska, on behalf of the Omaha Police Department and the Metro Drug Task Force, and Kevin T. Donlan to provide intelligence analyst services for the Metro Drug Task Force, for a term of one year from April 1, 2019 to March 30, 2020, and may be extended for two additional one-year terms upon mutual consent of the parties; that in consideration, the City shall pay Kevin T. Donlan an amount not to exceed $3,633.33 per month; $32,699.97 for 2019 (9 months) and $10,899.99 for 2020 (3 months); and to provide an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the attached Agreement between the City of Omaha, Nebraska, on behalf of the Omaha Police Department and the Metro Drug Task Force, and Kevin T. Donlan to provide intelligence analyst services for the Metro Drug Task Force for a term of one year from April 1, 2019 to March 30, 2020, which may be extended for two additional one-year terms upon mutual consent of the parties, is hereby accepted and approved. Section 2. In consideration, the City shall pay Kevin T. Donlan an amount not to exceed $3,633.33 per month; which contractual payments are contingent upon the continued funding from the Midwest HIDTA. The City, as the fiscal agent, will be reimbursed by the High Intensity Drug Trafficking Area (HIDTA) grant Fund 12155, Organization 130723, through the Office of National Drug Control Policy Section 3. That this Ordinance, not being of legislative character, shall be in full force and take effect upon its passage.

ORDINANCE NO. 41747
AN ORDINANCE to authorize payment to the University of Nebraska Medical Center (UNMC) for professional services to perform DNA testing needed by the Omaha Police Department, for a period of up to five years, involving the payment of money from appropriations of more than one (1) fiscal year in accordance with Sections 5.16 and 5.17 of the Omaha Home Rule Charter of the City of Omaha, 1956, as amended; to provide for the payment to the University of Nebraska Medical Center approximately $200,000.00 a year, for an estimated total of $1,000,000.00; and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Authority is hereby granted and approval hereby given to make payments to the University of Nebraska Medical Center for DNA testing needed by the Omaha Police Department. The City of Omaha shall pay the University of Nebraska Medical Center approximately $200,000.00 a year for a five-year period, involving the payment of money from appropriations of more than one (1) fiscal year in accordance with Sections 5.16 and 5.17 of the Omaha Home Rule Charter of the City of Omaha, 1956, as amended. Section 2. All payments for such services shall be paid from the Omaha Police Department General Fund 11111, Organization 114231 Criminal Investigations Bureau, Account 42271 Laboratory Testing. Section 3. This Ordinance, being not of a legislative character, shall be in full force and take effect immediately upon passage under and by virtue of the authority granted by Section 2.12 of the Home Rule Charter of the City of Omaha, 1956, as amended.

ORDINANCE NO. 41748
AN ORDINANCE to approve and authorize an Extension Amendment to a Contract between the City of Omaha, a municipal corporation, and Metropolitan Technical Community College Area, a political subdivision in the state of Nebraska, for services involving the payment of money from appropriations of more than one year in accordance with sections 5.16 and 5.17 of the Omaha Home Rule Charter of the City of Omaha, 1956, as amended; to provide for payment to Metropolitan Technical Community College Area on per-student basis for various training for an additional two (2) years commencing on January 1, 2019, with the cost of training varying from seventy dollars ($70.00) per person to four thousand eight hundred and fifty-two dollars ($4,852.00) per person in 2019 and for administrative costs of one hundred sixty-three thousand five hundred ($163,500) paid from the Omaha Fire Department Fund 11111, Organization 114572 EMS Training, 42239 Professional Fees; the Extension exercises the option of the City of Omaha to extend the Agreement for two (2) additional one-year periods; and to provide for an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Authority is hereby granted and approval hereby given for an Extension Amendment of a Contract between the City of Omaha and Metropolitan Technical Community College Area for services involving the payment of money from appropriations of more than one year in accordance with section 5.16 and 5.17 of the Home Rule Charter of the Home Rule Charter of the City of Omaha, 1956, as amended. The extension contemplates that the City of Omaha shall pay to Metropolitan Technical Community College Area fees on a per-person basis ranging from $70.00 per person for Basic Life Support (BLS) Training to $4,852.00 per person for initial Paramedic Training, in addition to administrative costs of $163,500 in accordance with the terms and conditions of the extension annexed hereto and by this reference made a part of this Ordinance. Section 2. That the City's obligation under the extension attached hereto shall be paid with funds from the Omaha Fire Department Fund 11111, Organization 114572, Account 42239 for professional services. Section 3. That the Mayor of the City of Omaha is hereby authorized to execute on behalf of the City of Omaha and the City Clerk to attest the attached Contract. Section 4. This Ordinance shall be in full force and take effect immediately upon passage under and by virtue of the authority granted by Section 2.12 of the Home Rule Charter of the City of Omaha, 1956, as amended.
