AN ORDINANCE to amend the official zoning map of the City of Omaha, adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 1247 South 16th Street from GI – General Industrial District to R5 – Urban Family Residential District.

SUMMARY:

AN ORDINANCE to amend the boundaries of the MCC – Major Commercial Corridor Overlay District, to incorporate into that district the property located at 8996 L Street.

SUMMARY:

In accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that:

ORDINANCE NO. 41221

AN ORDINANCE approving a redevelopment and tax increment financing loan agreement between the City of Omaha, a Nebraska Municipal Corporation in Douglas County, Nebraska, and inCommon Properties, LLC, a Nebraska Limited Liability Company, to implement the Hanscom Apartments Tax Increment Financing (TIF) Redevelopment Project Plan for a project site located at 1029 Park Avenue and 1040 South 29th Street, which proposes to rehabilitate two historic apartment buildings, the Bristol and the Georgia. The Bristol, at 1029 Park Avenue, will have 66 apartment units, and The Georgia, at 1040 South 29th Street, will have 9 units; the agreement authorizes the use of up to $322,986.00 in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project; and, providing for an effective date.

AN ORDINANCE to approve a contract between the City of Omaha and the Elkhorn Public Schools for the City to provide, through its assignment, one Associate School Resource Officer and a marked police cruiser, subject to the availability of such cruiser and Elkhorn's needs, to the premises of Elkhorn High School, located at 711 Veterans Drive, involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter, to perform police work at the District property twenty (20) hours per week while school is in session during the regular school year, from August 17, 2017 and ending at the close of the 2017 - 2018 school year; reimbursement from the Elkhorn Public Schools to the City will be in the amount of $31.00 per hour for the officer, not to exceed $24,314.00; and, to provide for an effective date hereof.

ORDINANCE NO. 41222

AN ORDINANCE to approve a contract between the City of Omaha and the Millard Public Schools for the City to provide, through its assignment, up to four Associate School Resource Officers, one Canine Associate School Resource Officer, and marked police cruisers, subject to the availability of such cruisers and the School District's needs, to specifically designated locations, involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter, to perform police work at the District property twenty-eight (28) hours (or less) per week while school is in session during the regular school year, and twenty-eight (28) hours per week while school is in session during the regular school year for the Canine Associate SRO, from August 14, 2017 and ending at the close of the 2017 - 2018 school year. The reimbursement payment from the Millard Public Schools to the City will be in the amount of $31.00 per hour for each officer; and $36.00 per hour for the canine officer; and $5.00 per day for the canine officer when school is not in session (summer break); and, to provide for an effective date hereof.

ORDINANCE NO. 41223

AN ORDINANCE approving an Agreement for fire protection and emergency medical services with the Millard Suburban Fire Protection District No. 1; providing that the Agreement will remain in effect for a period of ten (10) years in accordance with Section 5.17 of the Home Rule Charter of the City of Omaha, 1956, as amended; and, providing the effective date hereof.

WHEREAS, the City of Omaha and the Millard Suburban Fire Protection District No. 1 ("MSFD") have agreed since 1995 to have the City of Omaha Fire Department to provide service to Omaha and Millard service area residents by use of the nearest available fire protection and emergency medical responders; and,

WHEREAS, the City of Omaha and MSFD have agreed to continue contracting for ambulance services as permitted by NEB. REV. STAT. § 13-801 to 13-807 and 18-1706 to 18-1709 as amended and to continue to contract for cooperating and sharing fire prevention and protection services; and,

WHEREAS, acting through their governing bodies, MSFD and the City of Omaha wish to cooperate in developing the use of equipment, facilities, and personnel and procedures to enhance public safety and its efficient administration with the new respective areas and particularly to have the City perform fire and emergency services for the MSFD.

AN ORDINANCE to approve the acceptance of and authorize disbursement over more than one fiscal year from the Nebraska Crime Commission, FY 2016 STOP Violence Against Women (VAWA) Grant, Award #16-VW-0707 in the amount of two hundred and thirty-three thousand, one hundred and ninety-five dollars ($233,195), during the project period of July 1, 2017 to June 30, 2018; to enhance victim assistance services and prosecute cases of domestic violence through the multi-agency Douglas County Community Response Team as detailed in the attached grant application; to authorize payment from such grant funding and involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date thereof.

A SPECIAL ORDINANCE levying a special tax assessment for condemned buildings or structures in accordance with Section 48-93 of the Omaha Municipal Code on certain lots in the City of Omaha, Group No: 2017-01.

WHEREAS, it having been and being hereby adjudged, determined and established that several lots and pieces of real estate, hereinafter referred to have each been specially benefited for the full amount herein levied and assessed against each of said lots and pieces of real estate respectively, by reason of demolition of condemned buildings thereon, by the City of Omaha.

THEREFORE, for the purpose of paying the incurred cost of demolition.
