     Notice is hereby given that the City Council of the City of Omaha met on June 11, 2019 and passed and approved the ordinances entitled:
 
ORDINANCE NO. 41839
     AN ORDINANCE to approve a Major Amendment to a Mixed Use District Development Agreement for Aksarben Village, located at 2210 South 64th Avenue, to allow for the development of townhomes on the site, between the City of Omaha and Noddle Companies, providing site development standards; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha, in the interest of maintaining public health, safety, and welfare, desires to assure the property located at 2210 South 64th Avenue is developed in accordance with the provisions of the Major Amendment to a Mixed Use Development Agreement attached hereto and made a part hereof by reference. Section 2. That if this Ordinance, or portion thereof, is found to be invalid, any zoning ordinance applicable to such site shall not be invalidated for such reason. Section 3. That this Major Amendment to a Mixed Use Development Agreement is hereby approved. Section 4. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 41840
     AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone the property located northeast of Saddle Creek Road and Wakeley Street from R3-Single Family Residential (Medium Density) and GC-General Commercial District to GC-General Commercial. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. ORDINANCE NO. 41841
     AN ORDINANCE to amend the boundaries of the MCC-Major Commercial Corridor Overlay District, to incorporate into that district the property located northeast of Saddle Creek Road and Wakeley Street; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. In accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lot 1, Farrington's Poppleton Park, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska is hereby rezoned to be included in and incorporated into the MCC-Major Commercial Corridor Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance. Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 41842
     AN ORDINANCE to exercise the prior option to extend a contract by one year, to be effective from January 1, 2019 through December 31, 2019, this contract was initially approved by Ordinance 40616, on January 26, 2015, and all terms of the Original Contract remain in effect with Port-A-Johns for the collection of litter from City-Owned Litter/Recycle Receptacles, at a cost of $117,796.00 to the City of Omaha; to provide for payment from specific accounts; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City Council of the City of Omaha hereby approves the first of two optional, one year extensions of the contract with Port-A-Johns, for the collection of litter from City-Owned Litter/Recycle Receptacles to be effective from January 1, 2019 to December 31, 2019. Section 2. That the Finance Department is authorized to pay the cost of this contract extension according the actual use, in an estimated amount of $117,796.00 from the General Fund 11111, Solid Waste Collection and Disposal Organization 116321. Section 3. That this Ordinance, being administrative in nature, shall take effect and be in full force upon the date of its passage.

ORDINANCE NO. 41843
     AN ORDINANCE declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of the Nicholas Street Sewer Extension - Phase 3A, project identified as OPW 52721; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings be undertaken and completed; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That it is proper and necessary and it is hereby declared proper and necessary to appropriate certain private property for the purpose of the Nicholas Street Sewer Extension - Phase 3A, project identified as OPW 52721; Said property and lands necessary for such purposes are described as follows: See the attached Exhibit "A" plat drawing of abutting properties for which land acquisitions, permanent easements and temporary construction easements will be needed to complete this project. Section 2. That the Public Works Department of the City of Omaha be, and it hereby is, authorized, empowered, and directed to negotiate, through either employees of the City of Omaha or through persons employed therefor or through any combination thereof, with the owners of the above-described properties for the acquisition of said properties by the City of Omaha for aforesaid purposes. Upon failure to agree by negotiations with the owners of any of the above-described properties for the acquisition thereof by the City of Omaha, the Public Works Department is authorized, empowered, and directed, together with the Law Department of the City of Omaha, to proceed forthwith to acquire any such property, not obtained by negotiation, for the City of Omaha for the aforesaid purposes by condemnation proceedings in accordance with the Laws of the State of Nebraska under the power of eminent domain. Any notices in the name of the City of Omaha required to be given the owners or other persons having any interest in and to any of the above described real estate may be given by either the Public Works Department or the Law Department of the City of Omaha. The Public Works Department will be responsible for recording of all deeds, easements or other acquisition documents resulting from the exercise of the authority granted under this Ordinance in' the Register of Deeds Office in the appropriate county.      AN ORDINANCE to amend the title and Section 2 of Ordinance No. 41637, passed November 6, 2018, and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section I. That line 3 in the title of Ordinance No. 41637, passed November 6, 2018, be amended to read as follows: "properties generally located at 13909 13090 and 14001 L Street; and to provide for an effective date" Section 2. ORDINANCE NO. 41845
     AN ORDINANCE to accept the bid of Nifty Clean, LLC in the annual amount of $60,005.00, involving appropriations of more than one year as provided in 5.17 of the Home Rule Charter, to provide janitorial services at the Public Safety Training Center for a three year period, with two additional one-year options held by the City; to authorize the Finance Department to make payments from a specified account to Nifty Clean, LLC for the cost of janitorial services in accordance with the specifications; and to provide an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the bid of Nifty Clean, LLC in the annual amount of $60,005.00 for the furnishing of materials, labor, equipment, and all else necessary to perform satisfactory janitorial services at the Public Safety Training Center for a three year period, with two one-year options held by the City, is hereby accepted and the same hereby approved. Section 2. That the Finance Department is authorized to make payments to Nifty Clean, LLC for the cost of such services from the Omaha Police Department, General Fund 11111, Organization 113141 Fleet & Facilities, Account 42274 Janitorial Services; and from the Omaha Fire Department, General Fund 11111, Organization 114571, Account 42252 Contract Services. ORDINANCE NO. 41847
     AN ORDINANCE (1) to approve an agreement between the City of Omaha and the Douglas County Board of Commissioners, Douglas County Administrative Office in the amount of one hundred and eighty-three thousand, eight hundred fifty-five dollars ($183,855); and (2) to authorize funding for such agreement from the City of Omaha's FY 2018 Edward Byrne Memorial Justice Assistance Grant (JAG) Program, Award #2018-DJ-BX-0171, awarded by the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance; to provide funding for law enforcement equipment, prosecutor and corrections programs, and technology improvements and training; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha has been awarded the FY 2018 Edward Byrne Memorial Justice Assistance Grant (JAG) Program, Award #2018-DJ-BX-0171, from the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, in the amount of $376,710. Section 2. That the City of Omaha will retain $9,000 to provide grant administration and the balance of $367,710 will be equally split between the Omaha Police Department ($183,855) and Douglas County ($183,855). Section 3. That Douglas County's allocation of $183,855 will fund law enforcement equipment, prosecutor and corrections programs, and technology improvements and training, during the period of February 20, 2019 to September 30, 2021. Section 4. That, as recommended by the Mayor, the agreement between the City of Omaha and the Douglas County Board of Commissioners, Douglas County Administrative Office in the amount of one hundred and eighty-three thousand, eight hundred and fifty-five dollars ($183,855); is hereby approved. Section 5. That, the terms of the agreement shall extend through the award period of February 20, 2019 to September 30, 2021 commencing upon approval of this ordinance. In conformity with Section 5.17 of the Home Rule Charter, total expenditures as outlined in the attached budget, from such grant funds and involving appropriations of more than one year, are hereby authorized and the Finance Director is authorized to make payment in accordance therewith. Section 6. There is no match with this grant. Section 7. That this Ordinance being administrative, and not legislative, in character shall be in full force and take effect immediately upon passage.

     AN ORDINANCE to authorize and enter into an Agreement between the City of Omaha, a Municipal Corporation, Lutheran Family Services of Nebraska, Inc., and Behavioral Health Support Foundation, a Nebraska not-for-profit foundation for a period from April 1, 2019 through December 31, 2024 in order to create a Health, Wellness, and Crisis Intervention Unit, including a Mental Health Coordinator and licensed mental health professionals who will be embedded and work with the Omaha Police Department; and to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Authority is hereby granted and approval hereby given for the Mayor to sign and the City Clerk to attest the attached Agreement between the City of Omaha, a Municipal Corporation in Douglas County, Nebraska, Lutheran Family Services of Nebraska, Inc., and the Behavioral Health Support Foundation, a Nebraska not-for-profit foundation, for a period of April 1, 2019 through December 31, 2024. Section 2.      AN ORDINANCE to approve a Professional Services Contract between the City of Omaha, a Municipal Corporation and Municipal Code Corporation, a Florida Corporation, to provide services relative to the City's codified City code and the online versions provided by the Municipal Code Corporation; involving the payment of money from appropriations of more than one (1) year in accordance with Sections 5.16 and 5.17 of the Omaha Home Rule Charter of the City of Omaha, 1956, as amended; to provide for payment to the Municipal Code Corporation in the amount of $1,550.00 per year for online services with an annual administrative fee of $500.00 and other fees for services rendered for the initial three (3) year term; funds for this Agreement will be paid from City Law Department, Fund No. 11111, Org. No. 119014; to provide an effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Authority is hereby granted and approval hereby given for a Professional Services Contract between the City of Omaha and the Municipal Code Corporation involving the payment of money from appropriation of more than one (1) year, in accordance with Sections 5.16 and 5.17 of the Omaha Home Rule Charter of the City of Omaha, 1956, as amended and the Municipal Code Corporation shall provide services to the City of Omaha for a term of three (3) years with an annual fee of $1,550.00 for online services and an annual administrative support fee of $500.00 and other fees as incurred. Section 2. The City shall pay its obligations under this Professional Services Contract from the City Law Department, Fund No. 11111, Org. No. 119014. Section 3. That the Mayor of the City of Omaha is hereby authorized to execute on behalf of the City of Omaha, and the City Clerk, to attest the attached Contract. Section 4. SPECIAL ORDINANCE NO. 10261

     A Special Ordinance to approve the Omaha Downtown Improvement District Association (ODIDA) 2019-2020 Budget and Workplan and levying a special tax and assessment on all lots and pieces of real estate within Business Improvement District No. 687 4 in the City of Omaha in the amount of $541 ,120.50; such assessment shall cover the costs anticipated by the Business Improvement District for March 2019 to February 2020 and contemplated by Ordinance No. 37504 which was approved by the City Council of the City of Omaha on October 3, 2006, and reauthorized by Ordinance No. 38957 approved on March 8, 2011 and amended by Ordinance No. 41463 approved on April 26, 2018; and to provide an effective date therein. WHEREAS, it having been, and being hereby adjudged, determined and established that the several lots and pieces of real estate hereinafter referred will each specially benefit to the full amount herein levied and assessed against each of said lots and pieces of real estate, respectively, by reason of the improvements contemplated in Ordinance No. 37504, passed October 3, 2006, which established Business Improvement District No. 687 4 for purposes of maintenance and cleaning, public activity and promotion, and management and operations, Ordinance No. 38957 passed March 8, 2011, and Ordinance No. 41463, passed on April 26, 2018, within the Business Improvement District from March 2019 to February 2020. That the attached Omaha Downtown Improvement District Association (ODIDA) 2019/2020 Budget and Workplan which details the work to be done in Business Improvement District No. 6874 from March 2019 to February 2020 as described in Exhibit "A" attached hereto, which has been adopted as the Work Plan for said Business Improvement District is hereby approved. Section 2. That the cost of the Budget and Workplan for Business Improvement District No. 687 4 for March 2019 to February 2020, said cost being the sum of $541,120.50 ($485,037 of such cost being levied pursuant to Ordinance No. 41463, an additional $37,389.00 being assessed against the property of Union Pacific Railroad Company voluntarily as it is centrally assessed, and an additional $18,694.50 being assessed to the Metropolitan Entertainment & Convention Authority}, be and hereby is levied and assessed according to benefits by reason of said improvements, upon the following described lots Each assessment shall draw no interest from the time of the levy aforesaid, until the same shall become delinquent. Interest at the rate of fourteen percent per annum, as provided by State law, payable in advance, shall be paid on each delinquent assessment. Section 4. That the entire amount of tax so levied and assessed on any of said lots may be paid by any person on any part of said lots within fifty days from said levy and, thereupon, said lots or parts of lots shall be exempt from any lien or charge thereto. Section 5. That the City Council of the City of Omaha hereby approves the Omaha Downtown Improvement District Association 2019/2020 Budget & Workplan presented by the Omaha Downtown Improvement District Association (ODIDA) and Business Improvement District No. 687 4 which requests approval for the work contemplated by this Ordinance. Section 6. That this Special Ordinance shall take effect fifteen days after its passage and be in force thereafter.
