“NOTICE OF THE SITTING OF THE CITY COUNCIL AS A BOARD OF EQUALIZATION”

To the owners of lots, parts of lots and places of real estate described herein and abutting or adjacent to the streets, alleys , or avenues herein situated in whole or in part within any of the districts herein specified and all being within the City of Omaha, Douglas County, Nebraska.

 

You are hereby notified that the City Council of the City of Omaha will sit as a Board of Equalization in the Legislative Chamber in the Omaha/Douglas Civic Center, Omaha, Nebraska, at least one day from 1:00 p.m. until 2:00 p.m., commencing June 5, 2018, for the purpose of considering and equalizing the proposed levy of special taxes and assessments prepared by the Public Works Department and now on file in the O?ce of the City Clerk, and correcting any errors therein, and hearing all complaints that the owners of property so to be assessed and taxed may have to be made; said special taxes and assessments proposed to be levied being necessary to cover the actual cost of the public improvements duly authorized to be made pursuant to Section 34?331 to 34?334 of the Omaha Municipal Code and now completed as follows:

The respective amounts proposed to be assessed have been determined by or in connection with the use of a scaling back and graduating process with reference to benefits conferred by the improvements and all such amounts estimated to be uniform and not in excess of the benefits conferred by the improvements.

 

You are further notified that said proposed plan of assessment is now subject to the inspection and examination of any of the owners of said lots or pieced of real estate, or any other person interested in said proposed assessments at the O?ce of the City Clerk, and that it is proposed that unless for good and su?cient cause when it may be otherwise ordered and determined, the cost of said clearing of snow from sidewalk, respectively, shall be assessed on the several lots and pieces of real estate, as shown herein, and by said proposed plans and specifications pursuant to Section 34?333 of the Omaha Municipal Code.

 

WRITTEN PROTEST MUST BE FILED WITH THE CITY CLERK SEVEN DAYS BEFORE THE BOARD MEETING.

 

You are hereby notified to appear before the Board of Equalization at the time and place above specified to make complaints, statements or objections you may desire concerning any of said proposed levies and assessments of said special taxes.

To the owners of all lots, lands, tracts, and parcels of land within proposed Road Maintenance District No. 745-29, and to all owners of property abutting on and adjacent to Garden Road, from South 105th Street south to its terminus north of West Center Road:
 
Notice is hereby given that there has been filed with the City Clerk of the City of Omaha a petition for the improvement of Garden Road, from South 105th Street south to its terminus north of West Center Road, by asphalt overlay to the roadway, including grading and re-establishment of drainage, if warranted.
 
We, the undersigned, owners of lots or lands abutting upon that part of Garden Road, from South 105th Street south to its terminus north of West Center Road, in proposed Road Maintenance District No. 745-29 in the City of Omaha, being record owners of a majority of the feet frontage on said part of said street, as shown by the generally recognized maps of said city, do hereby petition that the same be improved by asphalt overlay to the roadway, including grading and re-establishment of drainage, if warranted.
 
And we do further petition the City Council to order such improvement and cause it to be made.  Within thirty days of first publication of this notice, the owners of property abutting the proposed improvement may:
1. By petition of a majority of said taxable front footage abutting the improvement, protest against the construction of such project pursuant to Neb. Rev. Stat. § 14-3,127; and,
2. By petition file a protest in the Office of the City Clerk against the regularity, legality, or sufficiency of the petition or signatures hereon, pursuant to Omaha Municipal Code § 26-61.
