Notice is hereby given that the City Council of the City of Omaha met on October 24, 2017 and passed and approved the ordinances entitled:
 
ORDINANCE NO. 41280
AN ORDINANCE approving an Agreement between the City of Omaha, Nebraska and Brian Sparks, of Cass County, Nebraska, involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for the terms and conditions under which Brian Sparks will receive and land apply stabilized sewage sludge, according to applicable standards, laws, and policies of the City of Omaha and other relevant jurisdictions for an agreement period ending December 31, 2017 with up to four automatic one-year renewals; to authorize the Finance Department to pay a sum not to exceed $0.60 per cubic yard of stabilized sludge from the Sewer Revenue Fund 21121; and to provide an effective date hereof.

ORDINANCE NO. 41279
AN ORDINANCE to accept the bid from LE Upfitter to enter into a two-year price agreement for ballistic vest systems with the option for two one-year extensions at the sole discretion of the City of Omaha, involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of the City of Omaha, 1956, as amended; to provide firm price commitments on ballistic vests for the first two years, which are to be provided the Omaha Police Department on an as needed basis, with unit prices specifically determined by the bid, but the exact costs are indeterminate depending on the number of purchases made, and anticipated to be approximately $497,745.00 for 900 vests over the four-year period; and to provide the effective date hereof.

AN ORDINANCE (1) to approve an agreement between the City of Omaha and Brenda L. Daley and Associates in the amount of thirty-six thousand, five hundred and four dollars ($36,504); and (2) to authorize funding for such agreement from the City of Omaha's FY 2016 Violent Gang and Gun Crime Reduction Program (Project Safe Neighborhoods): Category 3, Grant Award #2016-GP-BX-0008, awarded by the U.S. Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA); to provide funding for the position of the Project Safe Neighborhoods (PSN) Director of Operations; involving appropriations of more than one (1) year in conformity with Section 5.17 of the Home Rule Charter; providing for payment from a specific account; and, providing for the effective date hereof.

AN ORDINANCE to approve the acceptance of the City of Omaha and Douglas County joint application to the U.S. Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA), FY 2017 Edward Byrne Memorial Justice Assistance Grant (JAG) Program, Application #2017-H2311-NE-DJ, in the amount of three hundred and eighty thousand, eight hundred and thirty-six dollars ($380,836) for law enforcement programs, prevention and education programs, prosecution and court programs, mental health programs, and planning, evaluation and technology improvement programs during the period of October 1, 2016 to September 30, 2020; to provide the Council an opportunity for review and public comment for such application; and upon award of such grant to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, to provide for the effective date hereof.

ORDINANCE NO. 41283
AN ORDINANCE to amend Omaha Municipal Code Chapter 36, Article III , Division 6 by creating a new section prohibiting pedestrian use of certain medians within the public right-of-way; to provide findings of legislative intent, definitions, enforcement procedures, and affirmative defenses; and to provide an effective date hereof.

AIR QUALITY CONTROL
Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Omni Engineering for an operating permit for the hot mix asphaltic concrete plant at 2991 “G” Street, Omaha. The potential emissions, in tons, for this project will be: TSP 32.0, PM10 28.6, PM2.5 28.3, SOx 28.0, NOx 6.9, VOC 31.1, CO 90.3 and CO2e 9,419.
No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.
All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from November 1, 2017 to December 1, 2017. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position.  The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.  Comments should be mailed to:
