AN ORDINANCE AMENDING THE VILLAGE OF BOYS TOWN FIRE REGULATIONS, CHAPTER 6, ARTICLE 1, SECTION 6-102; TO PROVIDE FOR SEVERABILITY; AND TO PROVIDE FOR AN EFFECTIVE DATE.
Be it Ordained by the Chairperson and Board of Trustees of the Village of Boys Town, Nebraska, as follows:
Section 1. Findings. The Chairperson and Board of Trustees of the Village of Boys Town find that the Village of Boys Town Fire Regulations shall be amended as follows:
Chapter 6 - Fire Regulations
Article 1 - Fire Department and Rescue Squad
SECTION 6-102 - FIRE CHIEF
A. The Fire Chief means the certified or provisionally certified person appointed by the Village Board of Trustees to serve as the leader and Fire Chief of the Village of Boys Town Fire Department. The Chief shall manage the Fire Department and it shall be his/her duty to inform the Village Board when any of the fire engines, hose, ladders, or other apparatus needs repair. Upon the written consent and directive of the board, the Fire Chief shall cause the repair, improvement, or maintenance of the said equipment and shall personally supervise and approve of the same. It shall be the duty of the Fire Chief to come before the Village Board at the regular meeting in January each year to give a report of the general condition and the proposed additions or improvements recommended by him/her.
B. The Fire Chief shall, on the first day of April and October each year, file with the Village Clerk a certified copy of the rolls of all members in good standing in their respective companies in order to obtain the exemptions provided by law.
C. The Fire Chief shall enforce all laws and ordinances covering the prevention of fires, the storage and use of explosives and flammable substances, the installation of fire alarm systems, the regulation of fire escapes, and the inspection of all premises requiring adequate fire escapes. The Fire Chief shall have the right to enter at all reasonable hours into buildings and upon all premises within his jurisdiction for the purpose of examining the same for fire hazards and related dangers. The Fire Chief shall investigate the cause, origin, and circumstances of any fire arising within his jurisdiction.

Section 2. Severability. If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid for any reason, such invalidity shall not affect the validity of any remaining portion of this ordinance. The Chairperson and Board of Trustees of the Village of Boys Town, Nebraska hereby declare that the Village of Boys Town would have enacted and adopted this ordinance and each section, subsection, sentence, clause and phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid.
Section 3. Effective Date. This ordinance shall take effect from and after its passage, approval and publication as required by law, but not sooner than fifteen days after its passage.
