The meeting of the Board of the Village of Boys Town was held at 1:30 p.m. on Tuesday, August 3, 2021 in the Headquarters Building of Father Flanagan’s Boys’ Home in the Village of Boys Town, Nebraska.
Call to Order:
Chair Skartvedt called the meeting to order at 1:32 p.m.
Notice of Meeting:
The Notice of Meeting was posted on July 27, 2021, to Beacon, the Village of Boys Town website, and in the following designated public places in the Village of Boys Town: Town Hall, Visitor’s Center, and Headquarters. The Notice of Meeting was also published in The Daily Record on July 27, 2021.

The Pledge of Allegiance was recited.
Swear in Interim Trustee:
Appointed Trustee Joe West was sworn in by Chair Skartvedt, who administered the Nebraska Oath of Public Office.

SPECIAL PRESENTATION
Maddie Hagan, Mayor, shared her moving experiences from her recent visits to several civil rights locations and museums, including the following:
• Memphis: National Civil Rights Museum at the Lorraine Motel, Mason Temple, and Clayborn Temple
• Jackson: Mississippi State Fairgrounds and Civil Rights Museum
• Birmingham: 16th Street Baptist Church and National Civil Rights Museum
• Selma: National Voting Rights Museum and Edmund Pettus Bridge
• Montgomery: National Memorial for Peace and Justice, Legacy Museum, Rosa Parks Museum, and Dexter Avenue King Memorial Baptist Church
• Atlanta: Historical Black Colleges and Universities (HBCU) Tour and Friendship Baptist Church
Treasurer’s Report, Report on Claims to Be Paid, Report on Prepaid Claims:
Village Treasurer representative Tim Sharp reviewed the June 2021 Financial Report with the Trustees. The balance of all funds as of June 30 collectively $519,476. Detailed reports of claims to be paid and prepaid claims are attached herewith and become part of the minutes. Chair Skartvedt solicited a motion for consideration of and to approve action on accounts of the Village Treasurer, to approve the Village General Fund allowance and payment of claims.

Presentation of the full draft of 2021-2022 Preliminary Budget:
Village Treasurer Representative Tim Sharp presented the full draft of the 2021-2022 Budget for discussion. The special budget hearing open to the public will be held on August 24, 2021 at 1:30 p.m. and a vote on the final budget approval will be taken by the board at the regular meeting of the Village Board on September 7, 2021.
Report of the Village Police Chief:
Chief Clark was given approval to purchase a Tahoe to be used as the Chief’s primary response vehicle. The Tahoe will be outfitted to be used as a frontline vehicle when needed. The department schedule has been restructured to accommodate the beginning of the new school year. Chief Clark also provided an update on the department’s staffing. The application process to fill the vacant FTE positions was closed.
Report of the Village Fire Chief:
Chief Kava reported 300 kids went through the Summer Enrichment Program.
Report of the Village Engineer & Superintendent:
Joe Oetken provided an update on the Mother Theresa Lane Project, scheduled to begin the middle of August. The contracts are being finalized and will be sent to FFBH for signatures. There will be sewer maintenance cleaning on the West side of the lake.
Other Business:
Ordinance 347 Amending Section 2 of Ordinance 301 to establish 9 members on the Village of Boys Town Planning Commission:
The Village Clerk, James Beckmann, provided a brief explanation that Ordinance 347 amends Section 2 of Ordinance 301 to establish 9 members on the Village of Boys Town Planning Commission, which is a broader representation drawn from a cross section of those working within the Village as the Village looks to do different things with the development of land and property.
Normally, to pass a new ordinance, it must be read and reviewed/discussed at 3 straight meetings. However, there is a provision under Nebraska law to allow the Village to formally waive that requirement.
Upon MOTION duly made by Haack and seconded by West to waive the requirement that an ordinance must be read and reviewed/discussed at 3 straight meetings prior to being voted on has been passed.
Upon MOTION duly made by Haack and seconded by Gilg, Ordinance 347 Amending Section 2 of Ordinance 301 to establish 9 members of the Village of Boys Town Planning Commission has been passed. The Village Clerk conducted roll call:

Chair Skartvedt nominated the following individuals to be on the Planning Commission:

After Chair Skartvedt read the names the Board voted on the slate of Planning Commission Members.

Nebraska Ordinance No. 347
AN ORDINANCE TO AID IN CONTINUED GOOD GOVERNANCE BY REPEALING THE ORDINANCES SET FORTH BELOW; TO PROVIDE FOR SEVERABILITY; AND TO PROVIDE FOR AN EFFECTIVE DATE.
Be it Ordained by the Chair and Board of Trustees of the Village of Boys Town, Nebraska, as follows:
Section 1. Findings. The Chair and Board of Trustees of the Village of Boys Town find that Ordinance 301 in the Village of Boys Town Municipal Code shall be amended.
Section 2. Amendment of Ordinance. This ordinance shall hereby be amended and read the following. The remainder of the Ordinance 301, not hereby amended, shall remain the same.
“Section 2. The Village Planning Commission shall consist of nine members who shall represent insofar as possible different professions or occupations in the Village and who shall be appointed by the Chairman of the Village Board of Trustees, by and with the approval of a majority vote of the members elected to the Village Board of Trustees. All members of the Village Planning Commission shall serve as such without compensation and shall hold no other Village office. The term of each member shall be three years. All members shall hold office until their successors are appointed.”
Section 3. Severability. If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid for any reason, such invalidity shall not affect the validity of any remaining portion of this ordinance. The Chair and Village Board of Trustees of the Village of Boys Town, Nebraska hereby declare that the Village would have enacted and adopted this ordinance and each section, subsection, sentence, clause and phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid.
Section 4. Effective Date. This ordinance shall take effect from and after its passage, approval and publication as required by law, but not sooner than fifteen days after its passage.
