NOTICE IS HEREBY GIVEN that a regular meeting of the Mayor and City Council of the City of Bellevue will be held at 6:00 P.M. on Tuesday, August 18, 2020, at the Bellevue City Hall, 1500 Wall Street, Bellevue, Nebraska.

 

The agenda for the regularly scheduled meeting, which is kept continually current, may be amended as permitted by law and shall be available for public inspection during normal business hours at the office of the City Clerk at City Hall beginning Wednesday, August 12, 2020, at 4:00 P.M., and is available on the Internet at www.bellevue.net.

1. Bellevue City Council Proceedings

A meeting of the Mayor and Council of the City of Bellevue was called to order by Council President Don Preister, in the absence of Mayor Rusty Hike, at Bellevue City Hall at 6:00 p.m. on August 4, 2020.  Present were Council Members Bob Stinson, Paul Cook, Pat Shannon, Don Preister, Thomas Burns, and Kathy Welch. 

 

Notice of this meeting was given in advance thereof by publication in the Gretna Guide “Omaha Daily Record” and posted in two public places, the designated method for giving notice, and was given to the Mayor and all members of the City Council.  All proceedings hereafter were taken while the convened meeting was open to the public.  Council President Preister announced that a copy of the Open Meetings Act is posted in the back of the City Council Chambers.

 

Council President Preister led in the Pledge of Allegiance.  Associate Pastor Mick Huntley, Midlands Bible Baptist Church, 2407 Chandler Road East., gave the invocation.

 

The following items of business were considered:

1.  Council unanimously approved the Agenda and the Consent Agenda which included the following:   Approval of the July 21, 2020 Board of Equalization Minutes, Approval of the July 21, 2020 City Council Minutes; Acknowledgement of receipt of the July 28, 2020 Board of Health Minutes and Approval of the Claims.

2.  Interim Chief Dargy gave a presentation of “Officer of the 1st quarter,” “Officer of the 2nd quarter,” “Officer of the 3rd quarter,” and “Officer of the Year.”  The Budget Presentation was given after the first reading of Ordinance No. 4005: Annual Appropriations Bill.

3.  On a 5-1 vote, with Stinson voted no, Council approved  Ord. No. 4001:  Request to rezone Lots 1 through 3, Hidden Hills 2nd Addition, being a replat of Lots 43B1, 47B, and part of Lot 48B, Marian Park, all located in the N 1/2 of Section 25, T14, R13E of the 6th P.M., Sarpy County, Nebraska; and part of Lot 1, lying West of Canyon Road, the North 40’ of Lot 2, and Lot 3B1, Jewell Place, all located in the Southeast 1/4 of Section 25, T14N, R13E of the 6th P.M., Sarpy County, Nebraska from RE to RS-120 for the purpose of single family residential development; preliminary plat Lots 1 through 3, Hidden Hills 2nd Addition; and final plat Lots 1 through 3, Hidden Hills 2nd Addition.  On 5-1 votes, with Stinson voting no on each, Council approved the Preliminary Plat for Lots 1 through 3, Hidden Hills 2nd Addition and the Final Plat for Lots 1 through 3, Hidden Hills 2nd Addition.

4.  Council tabled Ord. No. 4002:  An Ordinance to amend section 29.5-1 through 29.5-25 of the Bellevue Municipal Code pertaining to the City Trees to the next council meeting, August 18th.

5.  The following ordinances were read for the first time:  Ord. No. 4003:  An Ordinance to amend the official zoning map of the City of Bellevue, Nebraska, as provided for by Article 3 of Ordinance No. 3619 by changing the zone classification of land located at or about Fort Crook Road South and Fairview Road, more particularly described in Section 1 of the ordinance and to provide an effective date; Ord. No. 4004:  An ordinance to amend the official zoning map of the City of Bellevue, Nebraska, as provided for by Article 3 of Ordinance No. 3619 by changing the zone classification of land located at or about 2221 Main Street, more particularly described in Section 1 of the ordinance and to provide an effective date;  and Ord. No. 4005:  An ordinance to adopt the budget statement to be termed the Annual Appropriations Bill; to appropriate sums for necessary expenses and liabilities; to provide for an effective date.  Second reading and public hearings will be held August 18th.

6.  Following public hearing, Council approved authorizing the Mayor to sign the Certifications and Assurances by the Chief Executive of the government for the Edward Byrne Memorial Justice Assistance Grant (JAG) Program.

7.   Council unanimously approved Res. No. 2020-33:  Approving participation in the Papio- Missouri River NRD Multi-Hazard Mitigation Plan.  On a 5-1 vote, with Shannon voting no, Council approved Res. No. 2020-34: Ordering an election to authorize the Bellevue At-Large City Council Position be eliminated and a 6th City Council Ward be created and added and requesting a consolidation with other elections occurring on November 3, 2020.

8.  The following items were unanimously approved by Council:  Approve and authorize the Mayor to sign the permanent sanitary sewer easement between Douglas County School District 0001 and the City of Bellevue, located in Lot 1, South Woods Replat 3; Approval of the Recording and Dictation system from Dragon Software, in an amount not to exceed 84,001.45; and Approve and authorize the Mayor to sign the Agreement with Dostals Construction Company, Inc. for the Lookingglass Height II Park Improvements Project to include a splash pad restroom facility, and parking area in an amount not to exceed $1,056,720.50 plus a 10% contingency totaling $1,162,392.55.

9.  Administrative Reports: A monthly report was given to all City Council members for review of the July reports from Administration.

10.  There being no further business to come before the Council at this time, on motion duly made and seconded, at 7:49 p.m. the meeting adjourned.

CITY OF BELLEVUE

ORDINANCE NO. 4001

 

AN ORDINANCE TO AMEND THE OFFICIAL ZONING MAP OF THE CITY OF BELLEVUE, NEBRASKA, AS PROVIDED FOR BY ARTICLE 3 OF ORDINANCE NO. 3619 BY CHANGING THE ZONE CLASSIFICATION OF LAND LOCATED AT OR ABOUT COMBS ROAD AND CANYON ROAD, MORE PARTICULARLY DESCRIBED IN SECTION 1 OF THE ORDINANCE AND TO PROVIDE AN EFFECTIVE DATE.

 

WHEREAS, having received a recommendation from the city of Bellevue Planning Commission and proper notice having been given and public hearing held as provided by law:

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BELLEVUE, NEBRASKA:

Section 1. That part of the official zoning map of the City of Bellevue, Nebraska, as provided in Article 3, of Ordinance No. 3619 is hereby amended to change the zone classification of the following described parcel of land:

Lots 1 through 3, Hidden Hills 2nd Addition, being a replat of Lots 43B1, 47B, and part of Lot 48B, Marian Park, all located in the North ½ of Section 25, T14, R13E of the 6th P.M., Sarpy County, Nebraska; and part of Lot 1, lying West of Canyon Road, the North 40’ of Lot 2, and Lot 3B1, Jewell Place, all located in the Southeast ¼ of Section 25, T14N, R13E of the 6th P.M., Sarpy County, Nebraska

From RE, (Residential Estates) to RS-120, (Single Family Residential, 12,000 Square Foot Zone)

Section 2. This ordinance shall not take effect until such time as the final plat of Hidden Hills 2nd Addition is filed with the Sarpy County Register of Deeds in accordance with Section 5-10 of the City of Bellevue Subdivision Regulations.

Section 3. Except as amended herein, the official zoning map and the classification shown therein shall remain as heretofore existing.

Section 4. This ordinance shall take affect and be in force from and after its adoption and publication according to law.

 

ADOPTED by the Mayor and City Council this 4th day of August 2020.
