Notice is hereby given that the Planning Commission of the City of Bellevue, Nebraska, will hold a regular meeting at 7:00 p.m. on August 26, 2021, in the City Council Chambers, City Hall, 1500 Wall Street, Bellevue, Nebraska, regarding:
1. Request to declare as Blighted and Substandard Lot 1, College Apartments Addition. Applicant: Stella Realty, LLC. General location: 400 W 19th Avenue. A copy of the study and map is located at the Planning Department.
An agenda of the meeting, which is kept continually current, is available for public inspection at the Planning Department located at 1510 Wall Street.

NOTICE OF HEARING
Notice is hereby given that the City Council of the City of Bellevue, Nebraska, will hold a regular meeting at 6:00 p.m. on August 17, 2021, in the City Council Chambers, City Hall, 1500 Wall Street, Bellevue, Nebraska, regarding:
1. Request to declare as Blighted and Substandard Lots 4 and 5, Edward Warren Addition, and Tax Lot H2, located in the Southwest ¼ of Section 16, T14N, R13E of the 6th P.M., Sarpy County Nebraska. Applicant: Imperial Homes, LLC. General location: 3501 Chandler Rd. W. A copy of the study and map is located at the Planning Department.
2. Request to approve the Redevelopment Plan for Lot 7, Tiller’s 4th Addition. Applicant: Freedom Village, LLC. General Location: 1811 Hillcrest Dr.
3. Request to rezone Lot 7, Tiller’s 4th Addition, from BG to RG-20-PS for the purpose of a senior living development. Applicant: Freedom Village, LLC. General Location: 1811 Hillcrest Drive.
4. Request to rezone Lots 1 and 2, Harold Square Replat One, from RG-50 to RG-20 and RG-50 for the purpose of a single-family residence and care facility for disabled adults. Applicant: Sharon Chaudhuri. General location: 8700 S 25th Street.

Bellevue City Council Proceedings

A meeting of the Mayor & Council of the City of Bellevue was called to order by Mayor Rusty Hike, at Bellevue City Hall at 6:00 p.m., on July 20, 2021. Present were City Council Members Bob Stinson, Paul Cook, Jerry McCaw, Thomas Burns, Don Preister, Kathy Welch; Absent: None.
Notice of this meeting was given in advance thereof by publication in the Gretna Guide & posting in two public places, the designated method for giving notice & was also given to the Mayor & all members of the City Council. All proceedings shown hereafter were taken while the convened meeting was open to the public.
Mayor Hike led in the Pledge of Allegiance. Pastor Steve Holdaway, LifeSpring Church, 13904 South 36th Street gave the Invocation.
The following items of business were considered:
1. Council unanimously approved the Agenda as prepared.
2. Council approved the consent agenda which included: Approval of July 6, 2021 City Council Minutes; Approval of the Claims; Approval to recommend reappointment of Sue Cutsforth and Rich Casey to the Bellevue Planning Commission for a three-year term, ending August 2024; Approval to recommend approving the changes of City Council Members serving on Task Forces and Committees, as noted & presented in the memorandum; and Approval to recommend reappointment of Doug Hill, Ralph Gladbach, Steve Knutson, and Steve Johnson to the Design Review Board for a three-year term, ending August 2024.
3. Council approved the following ordinances: Ord. No. 4040: An ordinance to amend the Official Zoning Map of the City of Bellevue, Nebraska, as provided for by Article 3 of Ord. No. 3619 by changing the zone classification of land located at or about 36th Street and Lexington Ave., more particularly described in Section 1 of the ordinance and to provide an effective date and the request of a small Subdivision Plat for Lot 1, 370 Square Replat Six, being a replat of Lots 1 and 2, 370 Square Replat IV; Ord. No. 4041: An ordinance to amend Article I, Chapter 20, of the Bellevue Municipal Code by adding a new Section 20-15 regarding failure to appear and to provide an effective date; and Ord. No. 4042: An ordinance to amend Chapter 7 pertaining to bicycles by amending Article I, Section 7-2 and repealing Article I, Section 7-1 and 7-11 and Article II in its entirety and to provide for the effective date of this ordinance.
4. Ord. No. 4044: An ordinance to amend the official Zoning Map of the City of Bellevue, Nebraska, as provided for by Article 3 of Ordinance No. 3619 by changing the zone classification of land located at or about 3501 Harrison Street, more particularly described in Section 1 of the ordinance and to provide an effective date, was read for a second time and opened for public hearing, along with the request to preliminary plat Lots 1 through 5, Svendsen Acres Replat One, the request to final plat Lots 1 through 5, Svendsen Acres Replat One, and the waiver of Section 6-4, Subdivision Regulations, regarding Street Design Standards. Mr. Patrick Sullivan was present on behalf of the applicant to answer any questions. No one spoke in favor or in opposition to this ordinance. Mayor Hike closed the public hearing and stated the third & final reading will be on August 3rd.
5. Ord. No. 4045: An ordinance to amend the official Zoning Map of the City of Bellevue, Nebraska, as provided for by Article 3 of Ordinance No. 3619 by changing the zone classification of land located at or about South 25th Street and Cornhusker Road, more particularly described in Section 1 of the ordinance and to provide an effective date was read for the second time and opened for public hearing, along with a request to preliminary plat Lot 1, Redwood 25 & a request to final plat Lot 1, Redwood 25. Mr. Paul DeKruiff, with Redwood Apartment Neighborhoods, gave a presentation to describe their company and go over their core values. Mr. Denis Neal and Mr. Kenny Spahn discussed some of their concerns they had with the development. Ms. Diana Gordon, who is a family member of the owners of the land spoke in favor of the development. Mayor Hike closed the public hearing with no one else coming forward to speak in support of in opposition to this ordinance. He stated the third and final reading will be on Aug. 3rd.
6. Public hearing was held to obtain input on the CDBG 2021 Action Plan with proposed funding recommendations. With no one speaking in support of or in opposition, Mayor Hike closed the public hearing. Council approved and authorized the Mayor to sign the 2021 Action Plan including Res. No. 2021-25: Authorizing the Mayor to sign and submit the 2021 Action Plan for the Oct. 2021 – Sept. 2022 Program Year; SF-424/424D; and Entitlement Certifications.
10. City Council approved the following items: Approve and authorize the Mayor to sign the Interlocal Agreement with the City of Omaha with Bellevue’s cost in an amount not to exceed $154,715.00, plus a 10% contingency of $15,471.50, for a total project cost in an amount not to exceed $170,186.50, for the Harrison Street, 36th to 48th St., Overlay Project; Approve and authorize the Mayor to sign the agreement with Alfred Benesch & Company for professional engineering services for Capehart Road Improvements, 27th to 36th Street Project, in an amount not to exceed $91,556.00; and Approve and authorize Mayor to sign agreement with Alfred Benesch & Co. for professional services for Schilling Drive from 9th Street to 13th Street, Bridge Removal, in an amount not to exceed $21,130.00.
11. Motion was made to approve and authorize the Mayor to sign the Franchise Agreement Addendum to the original agreement with Waste Connections of Nebraska, Inc. dba “Papillion Sanitation” for the collection, transfer, and delivery of residential solid waste, recyclable materials, and yard waste, followed by a motion to amend the Addendum by striking Article 17. Discussion ensued. Council approved opening this item up for public hearing.
Mrs. Epiphany Ramos, Wastewater & Solid Waste Superintendent, gave a review of the intent of this addendum and to answer questions. Mr. Neland Brown, Nebraskaland Recycling, was present to answer questions. Following public hearing a motion to amend the addendum failed on a 2-4 vote with Stinson, Cook, McCaw, and Welch voting no. Council then approved & authorized the Mayor to sign the First Addendum with Waste Connections of Nebraska Inc. dba “Papillion as presented. Council unanimously approved Res. No. 2021-20: Approval to amend the Master Fee Schedule to set the solid waste collection, recycling and yard waste fees for the Solid Waste Contract and to add fees for street/alley vacation.
12. Administrative Reports: Comments must be limited to items on the current Reports. (Monthly reports are given at the first Council Meeting of every month – July report will be attached to Aug. 3rd Council Packet.)
13. Council went into closed session for protection of the needless injury to the reputation of individuals involved in this in this matter. The subject matter to be discussed in closed session are confidential litigation updates. The following individuals were included in closed session: All City Council Members, Mayor Rusty Hike, City Administrator Jim Ristow, Attorney Bree Robbins, Asst. Attorney Annie Mathews, Community Development Director Mark Elbert, Susan Kluthe, Jani Jennings, Darryl Kuhlman, Ken Clary and Perry Guido. Council went into Closed Session at 7:49 p.m. and reconvened into open session at 8:50 p.m.
14. There being no further business to come before the Council at this time, on motion duly made & seconded, at 8:51 p.m. the meeting adjourned.
