Call to Order - Roll Call – Open Meetings Act
Mayor Clint Adams called the regular monthly meeting to order at 6:00 p.m. on Monday, July 14, 2025. In attendance were City Council Members Rob Hamilton, Adam Lee, and Shane Pekny. Member Kaye Bridgeford was absent. City Clerk Mindi Laaker identified the Open Meetings Act location that is available to the public.

Motion by Pekny, second by Lee to approve the Consent Agenda. All voted in favor and the motion carried.
Consideration of a Change of Zoning for 27.15 acres located at 10102 N. 156th St. in the Northwest corner of 156th and Rainwood Road from Transitional Agriculture (TA) to a Highway Commercial District (C-1) for the Rainwood Square Development Lots 1-12 and Outlots A-C
Consideration of a Preliminary Plat for 27.15 acres located at 10102 N. 156th St. in the Northwest corner of 156th and Rainwood Road for the Rainwood Square Development Lots 1-12 and Outlots A-C
City Engineer Julie Ogden, Larry Jobeun with Fullenkamp, Jobeun, Johnson & Beller and Gene Graves with Graves Development Resources presented the 12-lot development.
Adams opened a public hearing and there were no comments.
Motion by Pekny, second by Hamilton to approve the zoning change and preliminary plat subject to compliance with the City Engineer’s and Douglas County’s reports. All voted in favor and the motion carried.
Consideration of a Conditional Use Permit for a Martial Arts Studio in a Light Industrial District (I-1) located at 15311 Warehouse Street
City Engineer Julie Ogden and Business Owner Katie Nielsen presented a Martial Arts Studio.
Adams opened a public hearing and there were no comments.
Motion by Pekny, second by Lee to approve the Conditional Use Permit as presented subject to compliance with the City Engineer’s report. All voted in favor and the motion carried.
Consideration of a Conditional Use Permit allowing for an Indoor Training Facility in a C-1 Highway Commercial Zoning District located at 12744-12748 N. 158th Street in Bennington Contractor Bays, LLC
City Engineer Julie Ogden, Business Owner Bill Kruse and Property Owner Geoff McGregor presented a baseball training facility.
Adams opened a public hearing and there were no comments.
Motion by Pekny, second by Lee to approve the Conditional Use Permit as presented subject to compliance with the City Engineer’s report. All voted in favor and the motion carried.
Additional Street Closure – Saturday, August 9, 2025 from 8 a.m. to 1 p.m. Douglas County Farm Bureau Tractor Show – Rob Gottsch
Motion by Pekny, second by Hamilton to approve the closure as presented. All voted in favor and the motion carried.
Resolution 2025-02 for 1-Hour Parking Limits Located at South Second and South Stark Streets
Motion by Pekny, second by Lee to approve two pair of 1-hour signs. All voted in favor and the motion carried.
2026 Fireworks Permits – Bennington Jaycees and American Legion Post #266
Motion by Pekny, second by Lee to approve both 2026 permits. All voted in favor and the motion carried.
Public Works Building
A. Change Order #1 for Unsuitable Soils totaling $2,600
B. Pay Application #2 to Darland totaling $131,010.70
Motion by Pekny, second by Lee to approve Items A-B as presented. All voted in favor and the motion carried.
Program Agreement with the Nebraska Department of Transportation for the Big Papio Creek Trail Project No. CRP-TAP-28(175) 20% Local Match totaling $339,714
City Engineer Julie Ogden presented the project that will connect the existing pedestrian trail along Bennington Road with two under-bridge crossings and will avoid Bennington Rd., wind through Neumeyer Farm Park and end at 156th St.
Resolution 2025-03 Approving the Project Program Agreement with NDOT for the Big Papio Creek Trail Project, NDOT Project No. CRP-TAP-28(175)
Motion by Pekny, second by Lee to approve Resolution 2025-03 as presented. All voted in favor and the motion carried.
Library, Police, Public Works, Office and Project Tracker Reports
All monthly reports are on file in the City Office.
Police Report
Discussions were had regarding license plate readers, tasers and the purchase of a cruiser.
Public Comments
Comments were made regarding weed control.

Motion by Pekny, second by Lee to adjourn the meeting at 7:30 p.m. All voted in favor and the motion carried.
