Notice is hereby given that the City Council of the City of Omaha met on May 2, 2023 and passed and approved the following ordinances:

 

ORDINANCE NO. 43393

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northeast of 189th and Fort Streets from DR - Development Reserve District and R4 - Single-Family Residential District (High-Density) to DR - Development Reserve District.

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Outlots A-C, Enclave Flats Replat 1, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from DR - Development Reserve District and R4 - Single-Family Residential District (High-Density) to DR - Development Reserve District.

AN ORDINANCE to approve Amendment No. 2 to the Uptown District Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Uptown Properties, LLC, a Nebraska limited liability company which was approved by Ordinance No. 40805 on June 28, 2016; the amendment proposes the elimination of Phase Ill and IV, thereby decreasing the number of row houses from 113 mostly three story row houses, to a new total of 69 row houses; the amendment also decreases the original TIF loan from $5,084,978.00 to $3,099,228.00 in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project; and providing for an effective date.

NOTICE TO PUBLIC

 

The Omaha Streetcar Authority will have a Meeting at 1:30 P.M. on Monday, May 15, 2023, in the Legislative Chambers of the Omaha/Douglas Civic Center, 1819 Farnam Street in Omaha, Nebraska, for the purpose of discussing the agenda items and briefing and discussion of public business. This meeting will have video conference capability. Proposed agenda kept continually current shall be available for public inspection in the Omaha/Douglas Civic Center at the Office of the City Clerk, but the Authority shall have the right to modify the agenda to include items of an emergency nature only at such public meeting when convened. AIR QUALITY CONTROL

 

Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Metropolitan Utilities District to obtain a minor air emission construction permit for their pump station at 3308 Pacific Street, Omaha. The potential emissions, in tons, for this project will be: PM 0.5, PM10 0.5, PM2.5 0.5, SOx 0.1, NOx 55.4, VOC 0.7, CO 93.2, Acrolein 0.1, Formaldehyde 0.5 and CO2 equivalent 2901.

No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.

All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from May 10, 2023 to June 10, 2023. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position.  The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.  Comments should be mailed to:
