Notice is hereby given that the City Council of the City of Omaha met on June 6, 2023 and passed and approved the following ordinances:

 

ORDINANCE NO. 43426

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 1469 South 16th Street from GC-General Commercial District to R7- Multiple-Family Residential District (Medium Density).

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: LOT 10 AND THE SOUTH 1/2 OF LOT 11, BLOCK 14, KOUNTZE 3RD ADDITION, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from GC-General Commercial District to R7-Multiple-Family Residential District (Medium Density).

ORDINANCE NO. 43427

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 5125 South 24th Street from GI - General Industrial District to NBD - Neighborhood Business District (the property is located within an ACI - Area of Civic Importance Overlay District).

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 9-12 and ½ vacated alley adjacent, Block 8, South Omaha 1st Addition, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from GI - General Industrial District to NBD - Neighborhood Business District (the property is located within an ACI - Area of Civic Importance Overlay District).

ORDINANCE NO. 43428

AN ORDINANCE to amend the boundaries of the MCC-Major Commercial Corridor Overlay District, to incorporate into that district the properties located at 4110 and 4102 South 13th Street; and to provide for an effective date.

Summary: In accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: LOTS 1 AND 2, ROSEDALE ADDITION REPLAT 1, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned to be included in and incorporated into the MCC-Major Commercial Corridor Overlay District; provided, that the base zoning district for such properties shall not be changed by this ordinance.

ORDINANCE NO. 43429

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone the property located at 11607 and 11655 M Circle from R7-Medium-Density Multiple-Family Residential District and CC-Community Commercial District to CC-Community Commercial District.

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 7, West L Interchange Plaza Replat, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska along with LANDS SEC-TWN-RGE 05-14-12 -EX 22.91 AC STATE WW & IRR N 65 S165 W 305.24 FT & PT FOR HOLMES CR- W 1/2 E 1/2 SW 1/4 16.46 AC (PARCEL CONTAINS LEASED LAND #3000-3372-27) is hereby rezoned from R7-Medium-Density Multiple-Family Residential District and CC-Community Commercial District to CC-Community Commercial District.

AN ORDINANCE to amend the boundaries of the MCC-Major Commercial Corridor Overlay District, to incorporate into that district the property located at 11607 and 11655 M Circle; and to provide for an effective date.

SPECIAL ORDINANCE NO. 10342

AN ORDINANCE to amend certain portions of Special Ordinance No. 10338, levying a special tax and assessment on certain lots, parts of lots, and pieces of real estate in the City of Omaha, to cover the cost of constructing sidewalks in District No. SWR 2022-01, to reduce the assessment on the property listed below in the amount of $3,493.41 plus accrued interest; and to provide the effective date.

AN ORDINANCE to approve a Major Amendment to the Lakeside Plaza Mixed Use Development Agreement, located at 17202 Lakeside Hills Plaza, to allow Indoor Sports and Recreation within an existing multi-tenant building, between the City of Omaha and Bowl New England, Inc. d/b/a Spare Time Omaha, providing site development standards; and to provide for an effective date.

AN ORDINANCE in accordance with Section 5.10 of the Home Rule Charter of the City of Omaha, 1956, as amended, to transfer $43,867 in unencumbered appropriations in the 2023 Budget of the City of Omaha from the Wage Adjustment account to the Fire Department; and to fix the effective date hereof to be immediately upon passage in accordance with Section 2.12 of the Home Rule Charter of the City of Omaha, 1956, as amended.

AIR QUALITY CONTROL

 

Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Omni Engineering to renew their operating permit for the hot mix asphaltic concrete plant at 2991 “G” Street, Omaha. The potential emissions, in tons, for this facility are: TSP 38.0, PM10 33.7, PM2.5 33.3 SOx 20.3, NOx 28.3, VOC 1.9, CO 9.7. Ethylbenzene 0.5, POM 0.1, Xylene 0.6, Total HAPs 1.7 and CO2e 9,867.

No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.

All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from June 14, 2023 to July 14, 2023. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position.  The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.  Comments should be mailed to:

OHA is seeking proposals from qualified and licensed entities to provide Security Services to include standing guard or roving patrol (on-foot or vehicular), armed or unarmed, on/at various OHA development and facilities, on/at certain days and times.
