Notice is hereby given that the City Council of the City of Omaha met on August 31, 2021 and passed and approved the following ordinances:

ORDINANCE NO. 42657

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northwest of 195th Street and H.W.S. Cleveland Boulevard from AG-Agricultural District to MU-Mixed Use District.

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 1 through 4, and Outlots A through C, Sundance, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from AG-Agricultural District to MU-Mixed Use District.

ORDINANCE NO. 42658

AN ORDINANCE to approve a Major Amendment to a Mixed Use District Development Agreement between the City of Omaha and SD Omaha Property, LLC, for Avenue One, located northwest of 195th Street and H.W.S. Cleveland Boulevard, to allow for a multiple family residential use (251 residential units), providing site development standards; and to provide for an effective date.

AN ORDINANCE approving an Interlocal Agreement between the City of Omaha, Douglas County, and Sarpy County involving the disbursement and receipt of money involving appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for the terms and conditions under which Omaha is to cooperate with Douglas County and Sarpy County to provide Household Hazardous Waste services for the residents of Douglas and Sarpy County; to authorize the Finance Department to disburse and receive a cost share from Douglas County and Sarpy County not to exceed $125,000.00 annually per participant according to the schedule contained within the Agreement; and to provide an effective date hereof.

AN ORDINANCE to approve a Major Amendment to a Mixed Use District Development Agreement between the City of Omaha and West Gate Bank, for Thomsen Mile West, located at 17617 Manderson Street, to remove a Center Identification Sign prescribed for this lot by the development agreement and allow two detached signs closer than 100 feet, providing site development standards; and to provide for an effective date.

AN ORDINANCE to approve exercising two (2) one-year options for an Agreement between the City of Omaha and CorVel Enterprise Comp., Inc.; to provide workers’ compensation case management, claims management and risk management services for the City’s self-funded workers’ compensation program that was originally approved by the City Council on January 29, 2019 by Ordinance No. 41712 with such funds to be paid from Fund No. 11111, Organization No. 118017; with such fees to increase annually by the greater of the CPI or 3%; to provide an effective date herein.

AN ORDINANCE (1) to approve an agreement between the City of Omaha and Dr. Samantha Clinkinbeard in the amount of eleven thousand dollars ($11,000); and (2) to authorize funding for such agreement from the City of Omaha’s FY 2020 Law Enforcement Mental Health and Wellness Act (LEMHWA) Grant, Award #2020-MH-WX-K006, awarded by the U.S. Department of Justice, Office of Community Oriented Policing Services; to provide funding for research evaluation as part of the Omaha Police Department’s Peer Support Program; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof.

AN ORDINANCE authorizing the issuance of a purchase order to Abe’s Trash Service for a price agreement for rubbish container service for the Papillion Creek Water Resource Recovery Facility to be effective through December 31, 2022 with three, one year extensions at the sole option of the City; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from a specific account; and to provide an effective date hereof.

AN ORDINANCE to (1) approve an agreement between the City of Omaha and the Metro Area Continuum of Care for the Homeless (MACCH) in the amount of Sixteen Million Nine Hundred Eight Thousand Seven Hundred and Four Dollars and 30/100 ($16,908,704.30); and (2) to authorize funding for such agreement from U.S. Department of the Treasury Emergency Rental Assistance funds received by the City of Omaha under Section 3201 (a) of the American Rescue Plan Act of 2021, Pub. L. No. 117-2 (March 11, 2021); to be used to provide emergency rental and utility assistance for households at 80% of area median income or less who are impacted by the COVID-19 pandemic.
