NEBRASKA PUBLIC SERVICE COMMISSION

NOTICE

The Nebraska Public Service Commission will hold a public meeting on Wednesday, January 20, 2021 at 10:00 a.m. Under authority granted by Executive Order No. 20‑36, Corona Virus – Public Meetings Requirement Limited Waiver, issued by the Governor on November 25, 2020, this meeting of the Public Service Commission will be held via video conference.

Access to the meeting for members of the public and the media will be available via WebEx at the following link: http://tiny.cc/PSCWebex.

The agendas will be available for public inspection no later than 10:00 a.m. on the day before the meeting, on the Commission’s Calendar webpage: http://tiny.cc/PSCCal.

If auxiliary aids or reasonable accommodations are needed for attendance at a Commission meeting, please call the Commission at 402-471-3101.  For people with hearing/speech impairments, please call the Nebraska Relay System at 800-833-7352 (TDD) or 800-833-0920 (Voice).  Advance notice of at least seven days is needed when requesting an interpreter. 

NOTICE

The following proposed Rule and Regulation may be inspected at the offices of the Nebraska Public Service Commission during regular office hours. Comments must be filed with the Commission in the manner and within the time prescribed in Section 14 of the Rules of Commission Procedure:

RULE AND REGULATION #205: In the Matter of the Commission, on its own motion, seeking to amend Title 291, Chapter 14, Recreational Vehicles Rules and Regulations, to adopt the current editions of applicable code books and update related provisions.

Interested parties should submit written comments on the Proposed Rules set forth in Appendix A of the Order Opening Docket, Releasing Rules, Seeking Comment and Setting Hearing, no later than 3:00 p.m., Thursday, February 11, 2021.  Parties filing comments should file one (1) paper original, five (5) additional paper copies and one (1) electronic copy in Word format e-mailed to lisa.polivka@nebraska.gov and shana.knutson@nebraska.gov.

A public hearing to receive testimony on the proposed Rules and Regulations has been scheduled for Tuesday, February 23, 2021, at 1:30 PM. in the Commission Hearing Room, 300 The Atrium, 1200 N Street, Lincoln, Nebraska. Remote access to the hearing will be available via WebEx at the following link: http://tiny.cc/PSCWebex (case sensitive). Individuals may also attend the meeting by telephone: dial 408-418-9388, then enter 146 273 5624 when prompted for the access code.

The Commission believes there will be no fiscal impact as a result of these rules.

Copies of the proposed rules are available on the Commission website at https://psc.nebraska.gov/administration/proposed-rules-regulations. Anyone wishing to receive written notices regarding this docket shall provide contact information to the Commission and ask to be added to the service list.

Lincoln, Nebraska

Pursuant to NDEE Title 118 - Ground Water Quality Standards and Use Classification, public notification and opportunity for comment is hereby given of the following:

1.  On or about May 30, 1997, a petroleum release was identified originating from a storage tank system located at 5020 S 33rd Street, Omaha.  An approximate legal location is SE1/4, SW1/4, SW1/4, Section 04, Township 14N, Range 13E, Douglas County.

2.  Follow-up investigation identified the effects of the release and led to the remedial actions proposed by NDEE.  The investigation resulted in a determination that this ground water contamination event is defined as remedial action class three.

3.  The source of the release has been removed.  A Risk-Based Corrective Action (RBCA) Tier 1 assessment was conducted.  The assessment indicated the presence of dissolved petroleum compounds in ground water.  The contaminant concentrations found were below the numerical levels used by the RBCA process to establish a need for further investigation or remediation.  Based on the current site conditions and property use, the NDEE has determined that no further remedial action is necessary due to the lack of threat to human health or safety.

Any person may receive further information or submit comments on the proposed action, and request or petition NDEE for a hearing, in writing, stating the nature of the issues to be raised in the hearing, on or before February 11, 2021.  A final decision by the Director will be made in a manner provided by Title 115, NAC Ch. 5.  Direct written correspondence to:  Director, NDEE, P.O. 2.  Follow-up investigation identified the effects of the release and led to the remedial actions proposed by NDEE.  The investigation resulted in a determination that this ground water contamination event is defined as remedial action class three.

3.  The source of the release has been removed.  A Risk-Based Corrective Action (RBCA) Tier 1 assessment was conducted.  The assessment indicated the presence of dissolved petroleum compounds in ground water.  The contaminant concentrations found were below the numerical levels used by the RBCA process to establish a need for further investigation or remediation.  Based on the current site conditions and property use, the NDEE has determined that no further remedial action is necessary due to the lack of threat to human health or safety.

Pursuant to NDEE Title 118 - Ground Water Quality Standards and Use Classification, public notification and opportunity for comment is hereby given of the following:

1.  On or about November 2, 1990, a petroleum release was identified originating from a storage tank system owned by Thermo King.  The source of the release is located at 7514 F Street, Omaha.  An approximate legal location is SE1/4, SW1/4, SE1/4, Section 35, Township 15N, Range 12E, Douglas County.

2.  Follow-up investigation identified the effects of the release and led to the remedial actions proposed by NDEE.  The investigation resulted in a determination that this ground water contamination event is defined as remedial action class three.

3.  The source of the release has been removed.  A Risk-Based Corrective Action (RBCA) Tier 1 assessment was conducted for one or more of the following exposure pathways of concern:  surface soils, ground water ingestion, soil leaching to ground water, and intrusion of vapors to a structure from contaminated ground water and contaminated soils.  The contaminant concentrations found were below the numerical levels used by the RBCA process to establish a need for further investigation or remediation.  Based on the current site conditions and property use, the NDEE has determined that no further remedial action is necessary due to the lack of threat to human health or safety.

Information regarding this release is contained in the file:  NDEE ID 10341, LST 032294-GW-1130.
