STATE OF NEBRASKA PUBLIC NOTICES 9/2/22

NEBRASKA PUBLIC SERVICE COMMISSION

The following application(s) may be inspected at the office of the Nebraska Public Service Commission during regular office hours.  Interventions must be filed with the Commission in the manner and within the time prescribed in Section 14 of the Rules of Commission Procedure, Title 291, NAC Chapter 1.

C-5431 In the Matter of the Application of Michael Wood, Robert Haburchak, and Janet Schwager, Ewing, each seeking authority to receive advanced telecommunications service from the Ewing Exchange of Great Plains Communications.

NOTICE

The Nebraska Public Service Commission will hold a hearing on Tuesday, September 27, 2022 at 11:00 a.m. in the Commission Hearing Room, 300 The Atrium, 1200 N Street, Lincoln, Nebraska regarding the following dockets:

RVF-16     In the Matter of the Commission, on its own motion, seeking to determine the fees for the Recreational Vehicle Program.

MODF-16  In the Matter of the Commission, on its own motion, seeking to determine the fees for the Modular Housing Program.

MANF-15  In the Matter of the Commission, on its own motion, seeking to determine the seal fee amount for the Manufactured Home Program.

NOTICE OF IN-PERSON MEETING

The Nebraska Public Service Commission will hold a public meeting on Tuesday, September 13, 2022 at 10:00 a.m. in the Commission Hearing Room, 300 The Atrium, 1200 N Street, Lincoln, Nebraska.

Remote access to the meeting will be available to the public at: http://psc.nebraska.gov/stream. Individuals may also attend the meeting by telephone: dial 408-418-9388, then enter 146 273 5624 when prompted for an access code.

The agendas will be available for public inspection at the Commission no later than 10:00 a.m. on the day before the meeting. The agendas will also be available on the Commission’s Calendar webpage at http://psc.nebraska.gov/calendar.

PUBLIC NOTICE

NEBRASKA DEPARTMENT OF ENVIRONMENT AND ENERGY

Lincoln, Nebraska

Pursuant to NDEE Title 118 - Ground Water Quality Standards and Use Classification, public notification and opportunity for comment is hereby given of the following:

1. On or about September 3, 2021, a petroleum release was identified originating from a storage tank system owned by Dolphin’s, Inc.  The source of the release is located at 2511 S 140th Street, Omaha.  An approximate legal location is SE1/4, SW1/4, SW1/4, Section 25, Township 15N, Range 11E, Douglas County.

2. Follow-up investigation identified the effects of the release and led to the remedial actions proposed by NDEE.  The investigation resulted in a determination that this ground water contamination event is defined as remedial action class three.

3. The source of the release has been removed.  A Risk-Based Corrective Action (RBCA) Tier 1 assessment was conducted for one or more of the following exposure pathways of concern:  surface soils, ground water ingestion, soil leaching to ground water, and intrusion of vapors to a structure from contaminated ground water and contaminated soils.  The contaminant concentrations found were below the numerical levels used by the RBCA process to establish a need for further investigation or remediation.  Based on the current site conditions and property use, the NDEE has determined that no further remedial action is necessary due to the lack of threat to human health or safety.

Any person may receive further information or submit comments on the proposed action, and request or petition NDEE for a hearing, in writing, stating the nature of the issues to be raised in the hearing, on or before October 3, 2022.  A final decision by the Director will be made in a manner provided by Title 115, NAC Ch. 5.  Direct written correspondence to:  Director, NDEE, P.O.
