REGULAR MEETING PROCEEDINGS

November 11, 2024

The Board of Trustees of the Village of Waterloo met for a Regular Meeting on November 11, 2024 at 7:00 pm in the Village Office, 509 S. Front Street. Present were Chairperson Travis Harlow and Trustees Rotert, Sass, Rochford and A. Harlow. Attorney Solomon and Clerk Smith were also present.

Chairperson T. Harlow called the meeting to order at 7:00pm and stated the location of the Open Meetings Act. Notice of the meeting was duly exercised and mailed per the bylaws. Minutes from the October 14, 2024 Regular Meeting and the October Treasurer Report were approved as presented.

The following bills were approved be paid (T. The following motions were approved:

-    To approve Resolution 11-11-24-01, to approve appointment of Staci Northwall as a Park and Tree Board member

-    To approve Resolution 11-11-24-02, to approve appointment of Kelsey Forman as a Park and Tree Board member

-    To approve Resolution 11-11-24-03, to approve appointment of Diana Kult as an alternate Park and Tree Board member

-    To approve Resolution 11-11-24-04, approve purchase of 2025 Durango from ESU Pursuits at a cost of $46,900.00

-    To approve Resolution 11-11-24-05, approve installation of flooring at the library by Carpet Land at a cost of $8,357.29. Motion by T, Harlow, seconded Rotert, to approve library spending up to $8,000.00 on flooring from the vendor they choose

- A hearing was opened at 7:13pm to discuss a variance application by Red Dog Building Group for lots 3 and 4 in Harvest Heights on the Creek for commercial buildings to be placed closer than the required be placed closer than the required 17ft distance from another structure. No public comments were heard. The hearing was closed at 7:14pm. The variance was approved. T. Harlow abstained

-    A hearing was opened at 7:15pm to discuss a variance application by Schurman Corp for 3200 N 240 St, to permit placement of street access to be located closer than 150’ from the intersection as recommended by the street superintendent. No other public comments were made. The hearing was closed at 7:19pm. The variance was approved

-    A hearing was opened at 7:19pm to discuss Ordinance 847 – first reading to approve annexation of Aspen Lake Subdivision (portion between Blondo Street and Maple Street, 252nd Street and Highway 275). No public comments were heard. The hearing closed at 7:20pm. The ordinance was approved

-    To accept the renewal as proposed

-    To approve Resolution 11-11-24-06, Year-end Certification of Street Superintendent

-    To approve Resolution 11-11-24-07, to approve JEO contract for Wastewater Treatment Facility Lift-station project

-    To approve $250.00 donation to Western Douglas County Chamber of Commerce/COPE holiday food basket program

-    To waive the three readings for Ordinance 845, update FIRM and FIS dates in floodplain regulations

-    To approve Ordinance 845

-    To go into executive session to discuss possible litigation and to protect the attorney client privilege at 7:36pm for approximately 10 minutes. T. Harlow stated the executive session was to discuss possible litigation and to protect the attorney client privilege

-    To leave executive session at 7:57pm

Rochford wanted to acknowledge and show appreciation for A. Harlow at her final full meeting. There being no further business, the meeting was adjourned at 7:57pm.

Special meetings are scheduled for November 18, 2024 at 6:00pm and November 25, 2024 at 6:00pm. The next regular meeting is scheduled for December 9, 2024 at 7:00pm.

A hearing was opened at 6:00 pm to discuss Ordinance 847 – second reading to approve annexation of Aspen Lake Subdivision (portion between Blondo Street and Maple Street, 252nd Street and Highway 275). No public comments were heard. The hearing closed at 6:01 pm. Ordinance 847 was approved as presented.

Resolution 11-18-24-01, to approve changing the time of the Park and Tree Board meetings to 5:00 pm was approved as presented.

ADJOURNMENT

There being no further business, the meeting was adjourned at 6:03 pm. A Special Meeting is scheduled for November 25, 2024 at 6:00 pm. The next regular meeting is scheduled for December 9, 2024 at 7:00pm.

Public Notice is hereby given that a meeting of the Village Board of Trustees of the Village of Waterloo, Nebraska, held at 7:00 o’clock P.M. on December 9, 2024, there was passed and adopted Ordinance No. 848 entitled:

AN ORDINANCE AMENDING CHAPTER 5 OF THE MUNICIPAL CODE OF THE VILLAGE OF WATERLOO, NEBRASKA BY AMENDING SECTION 5-302(A) CHANGING TELECOMMUNICATIONS OCCUPATION TAXES TO FOUR PERCENT (4%) TO REFLECT THE RECENT CHANGES IN STATE LAW; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR THE REPEAL OF ALL ORDINANCE IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECT DATE OF THIS ORDINANCE.

Which Ordinance No. 848 is published in pamphlet form, copies of which are available for inspection and distribution at the Office of the Village Clerk at the Village Clerk’s Office in the Village of Waterloo, Nebraska.
