Notice is hereby given that the City Council of the City of Omaha met on October 22, 2019 and passed and approved the ordinances entitled:

 

ORDINANCE NO. 42002

AN ORDINANCE to amend the boundaries of the ACI-3-Area of Civic Importance Overlay District, to incorporate into that district the property located at 601 North 108th Circle; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. In accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: LANDS SEC-TWN-RGE 16-15-12 -EX N 793.67 FT- PT N & W OF STATE H/W SW 1/4 SW 1/4 in Douglas County, Nebraska is hereby rezoned to be included in and incorporated into the ACl-3-Area of Civic Importance Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance. Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 41999

AN ORDINANCE to approve a Major Amendment to a Mixed Use District Development Agreement for Altech Business Park, located northwest of 144th and F Streets, to add language that limits the amendment only to Lot 1, Altech Business Park Replat 11, between the City of Omaha and Ted Grace, providing site development standards; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha, in the interest of maintaining public health, safety, and welfare, desires to assure the property located northwest of 144th and F Streets is developed in accordance with the provisions of the Major Amendment to a Mixed Use Development Agreement attached hereto and made a part hereof by reference. Section 2. That if this Ordinance, or portion thereof, is found to be invalid, any zoning ordinance applicable to such site shall not be invalidated for such reason. Section 3. That this Major Amendment to a Mixed Use Development Agreement is hereby approved. Section 4. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 42000

AN ORDINANCE to provide regular tree grinding and disposal of tree debris collected and deposited by the City at the City’s Tree Debris Management Site or at other temporary sites established by the City during times of storms or other natural or man-made events causing significant tree debris to assist the public in post event cleanup efforts. The Agreement specifies the terms and conditions for such services between the City and Soil Dynamics Composting Farm through year 2020. This Agreement may be extended for five (5) additional one-year terms, if the City exercises the option. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the Agreement for tree grinding and disposal services, Soil Dynamics Composting Farm shall charge the City on the following basis:  Grinder Charge: $650 per hour Wheel Loader Charge (Special Grindings): $150 per hour Mobilizations Charge (Quarterly Grindings): No Charge Mobilization Charge (Special Grindings): $1,000 per event Section 2. That the Finance Director of the City of Omaha is authorized to make payments in accordance therewith from the General Fund No. 11111 and Organization No. 115025, Ground Maintenance Contracts. Section 3. That this Ordinance, not being of legislative character, shall be in force and take effect immediately upon its date of passage.

ORDINANCE NO. 42001

AN ORDINANCE (1) to approve an agreement between the City of Omaha and Dr. Gaylene Armstrong in the amount of one hundred and fifty thousand dollars ($150,000); and (2) to authorize funding for such agreement from the City of Omaha’s FY 2018 Justice and Mental Health Collaboration Program (JMHCP) Grant, Award #2018-MO-BX-0004, awarded by the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance; to provide funding for research evaluation as part of the Heartland Crisis Intervention Team (CIT) Project; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, the agreement between the City of Omaha and Dr. Gaylene Armstrong in the amount of one hundred and fifty thousand dollars ($150,000), budgeted from the FY 2018 Justice and Mental Health Collaboration Program (JMHCP) Grant, Award #2018-MO-BX-0004, awarded by the U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance; to provide funding for research evaluation as part of the Heartland Crisis Intervention Team (CIT) Project, is hereby approved. Section 2. That, the terms of the agreement shall extend through the award period of January 1, 2019 to December 31, 2021 commencing upon approval of this ordinance. In conformity with Section 5.17 of the Home Rule Charter, total expenditures as outlined in the attached budget, from such grant funds and involving appropriations of more than one year, are hereby authorized and the Finance Director is authorized to make payment in accordance therewith. Section 3. That, there is a total match of $155,592 with this grant award. The Omaha Community Foundation will provide a match of $30,000, the First Responders Foundation will provide a match of $75,000, Metropolitan Community College will provide an in-kind match of $36,000, the Nebraska Humane Society will provide an in-kind match of $3,600, the University of Nebraska at Omaha will provide an in-kind match of $3,600, and Douglas County Department of Corrections will provide an in-kind match of $7,632. Section 4. That this Ordinance being administrative, and not legislative, in character shall be in full force and take effect immediately upon passage.

CITY of OMAHA

AIR QUALITY CONTROL

Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Magellan Pipeline Company for a renewal to their air emission operating permit for the petroleum products terminal at 2205 North 11th Street, Omaha. The potential emissions, in tons, for this project will be: VOC 199.6, Benzene 1.8, Ethylbenzene 0.2, Hexane 3.2, Toluene 2.6, 2,2,4-Trimethylpentane 1.5 and Xylene 1.0.

No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.

All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from October 30, 2019 to November 30, 2019. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position.  The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.  Comments should be mailed to:
