ORDINANCE NO. 44348

AN ORDINANCE to approve a Major Amendment to a Mixed-Use District Development Agreement for SOUTH FARM, for the property located southwest of 144th and Pacific Streets, allow for development of the site with a variety of office, commercial, and residential uses.

ORDINANCE NO. 44347

AN ORDINANCE to approve a Major Amendment to a PUR-Planned Unit Redevelopment Overlay District located at 3005 and 3006 Emmet Street, to approve the Development Plan, and to provide for an effective date.

Summary: In accordance with Sections 55-595 through 55-600 of the Omaha Municipal Code, a Major Amendment to the PUR-Planned Unit Redevelopment Overlay District and the Development Plan, attached hereto and made a part hereof, are hereby approved, for the following described land in Douglas County, Nebraska: Lots 1 and 2, Kennedy Square West, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska.

ORDINANCE NO. 44352

AN ORDINANCE rescinding Ordinance No. 42580, passed on June 29, 2021 approving a Tax Increment Financing (TIF) Redevelopment Agreement with 18HowardOwner, LLC, a Nebraska limited liability company, and subsequent administrative amendments, to implement The 18Howard Tax Increment Financing (TIF) Redevelopment Project Plan for the redevelopment site located at 1819 Howard Street and 1810 St. Mary’s Avenue, which proposed the new construction of a five-story mixed-use building with approximately 120-124 apartments and 20,000 square foot of first floor commercial space. There would be 40 parking stalls leased from the adjacent new development at 508 South 19th Street and another 40 off-street parking stalls provided for residential use, and providing for an effective date.

ORDINANCE NO. 44353

AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and GPA Properties, LLC, a Nebraska limited liability company, to implement the South Omaha Global Market Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 5125 South 24th Street, which proposes a comprehensive rehabilitation of the currently vacant building to be redeveloped as a business incubator for food processing businesses, with 16 indoor food vendor spaces available to lease and an indoor event space for weekend markets and similar events; the agreement authorizes the use of up to $827,591.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date.

ORDINANCE NO. 44354

AN ORDINANCE to approve the acceptance of and authorize disbursement over more than one fiscal year for a grant award agreement for Award #197-2026-DA3009 from the Nebraska Crime Commission on Law Enforcement and Criminal Justice (Nebraska Crime Commission) in the amount of sixty thousand dollars ($60,000), during the project period extending from July 1, 2025 to June 30, 2026 for the Omaha Police Department (OPD) SFY 2026 Edward Byrne Memorial Justice Assistance Grant (JAG) Program award; to implement a Criminal Justice Internship Program; to authorize payment from such grant funding and involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charger; and, providing for the effective date thereof.

ORDINANCE NO. 44355

An Ordinance authorizing and approving an amendment to that certain Master Lease-Purchase Agreement (Streetcar Projects) dated as of February 1, 2024, with the additions of Schedules I, II and III thereto (collectively, the “Agreement”) between the City of Omaha Public Facilities Corporation (the “Corporation”) and the City of Omaha, Nebraska (the “City”), to provide funds for the lease-purchase of and the financing of a portion of the costs of acquiring, constructing and equipping a modern streetcar system, including the lease-purchase of streetcars, an operations and maintenance building, streetcar track and all related public improvements (collectively, the “Project”); authorizing an amendment, if necessary to that certain Site Lease Agreement dated as of February 1, 2024 (the “Site Lease”) between the Corporation and the City for the ground leasing of the Project site by the City to the Corporation; authorizing and approving, if necessary, one or more Bills of Sale (collectively, the “Bills of Sale”) by the City to the Corporation for the sale of certain equipment to the Corporation; approving a Third Supplemental Indenture (collectively, the “Indenture”) between the Corporation and BOKF, National Association, as Trustee and Paying Agent; approving the terms and conditions of one or more series of the Corporation’s Lease Revenue Bonds (the “Bonds”), as set forth in the Indenture and the issuance and delivery thereof; delegating authority to the City Finance Director to determine for each series of Bonds authorized under such Ordinance, the final form of the amendments to the Agreement, the amendment, if necessary, to the Site Lease, any Bills of Sale and the Indenture, the final price, interest rates, principal amount, redemption provisions, and other terms and conditions thereof; and satisfying applicable federal income tax law requirements and approving the effective date hereof.

An Ordinance authorizing and approving a Lease Purchase Agreement ( the “Agreement”) between the City of Omaha Public Facilities Corporation (the “Corporation”) and the City of Omaha, Nebraska (the “City”) a copy of which Agreement is attached hereto as Exhibit A and incorporated herein by this reference, to provide funds for the lease-purchase of and the financing of the acquisition of real estate for the City’s Riverfront Revitalization Area; authorizing and approving an Amended and Restated Site Lease Agreement (the “Site Lease”) between the Corporation and the City for the leasing of the project site by the City to the Corporation, a copy of which Site Lease is attached hereto as Exhibit B and incorporated herein by this reference; approving an Indenture of Trust (the “Indenture”) between the Corporation and BOKF, National Association, as Trustee and Paying Agent, a copy of which Indenture is attached hereto as Exhibit C and incorporated herein by this reference; approving the terms and conditions of the Corporation’s approximately $8,500,000 aggregate principal amount Lease Revenue Bonds, Series 2025D (the “Bonds”), to be issued in one series as set forth in the Indenture and the issuance and delivery thereof; delegating authority to the City’s Finance Director to determine the final price, interest rates, principal amount and redemption provisions for the Bonds; and satisfying applicable federal income tax law requirements and approving the effective date hereof.

An Ordinance authorizing and directing an issue of general obligation bonds of the City of Omaha, Nebraska in the aggregate principal amount of not to exceed $45,000,000 to be termed for identification purposes “General Obligation Bonds, Series 2025A”; prescribing the form of said bonds; authorizing the sale of said bonds by negotiation; directing the preparation of a transcript of proceedings authorizing the issuance, sale and delivery of said bonds; appointing a Paying Agent and Registrar; approving the selection of an underwriter; directing that said bonds shall initially be issued and registered in book entry form; providing for continuing disclosure; delegating authority to an Authorized Officer to determine the final prices, interest rates, principal amounts and redemption provisions for said bonds; and providing for the effective date thereof.

NOTICE IS HEREBY GIVEN that the City Council of the City of Omaha, Nebraska, will hold public hearings on August 19, 2025, at 2:00 PM in Legislative Chambers, 1819 Farnam Street, Omaha, Nebraska 68183. The purpose of these hearings is to consider approval of:

 

Class CL Liquor License for Big Grove Omaha LLC dba Big Grove Omaha located at 4601 Catalyst Court, Suite 1002.

 

Class C Liquor License for Naena LLC dba Naena located at 2229 Leavenworth Street, Building 2.

AIR QUALITY CONTROL

NOTICE TO PUBLIC

 

Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Ready Mixed Concrete to renew the air emission operating permit for the concrete batch plant at 700 Seward Street, Omaha. The potential emissions at this facility, in tons, will be: PM10 13.2 and PM2.5 13.2.

No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.

All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from August 6, 2025 to September 6, 2025. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position.  The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.  Comments should be mailed to:
