CITY OF OMAHA

Notice is hereby given that the City Council of the City of Omaha met on July 21, 2020 and passed and approved the following ordinances:

 

ORDINANCE NO. 42267

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing ce1iain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located southeast of 87th and Pacific Streets from R2-Single-Family Residential District (Low- Density) to R4-Single-Family Residential District (High-Density). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section I. The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 1-18 and Outlots A-C, Estates at Loveland, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned f om R2-Single-Family Residential District (Low-Density) to R4-Single-Family Residential District (High-Density). Section 2. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage.

ORDINANCE NO. 42268

AN ORDINANCE to amend Omaha Municipal Code Sections 34-57 to create a penalty for those who commence excavation in City right-of-way without a permit; the penalty of $100 per day will continue up such time as a permit is secured; to repeal Sections 34-57 as heretofore existing; and to provide the effective date thereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That Omaha Municipal Code Sec. 34-57 is hereby amended to read as follows:

 

Sec. 34-57. -Application.

 

Any eligible person desiring a permit required by the provisions of this division shall make application therefor to the permits and inspections division, giving such information as the division shall require. The permit application shall be in the form of the City of Omaha, public works department, street maintenance division’s “application for excavation permit.” The combination application/permit form shall include:

(a) Date of application;

(b) Name of permittee;

(c) Location of work;

(d) Planned size of opening in lineal feet (meters;

(e) Description of work;

(f) Time required to complete the excavation;

(g) Signature of the applicant;

(h) Date approved by the department;

(i) Date excavation is approved to begin;

(j) Date excavation is to be completed;

(k) Permit number;

(l) Signature of street maintenance engineer;

(m) Bond or surety company name as required in section 34-56.

 

Public utilities may fax or send applications directly to the city street maintenance engineer rather than to the permits and inspections division. After review by the engineer, the permit will be issued if approved.

 

A permit shall expire 30 days after its issuance. No lane shall be closed for longer than five calendar days. An extension may be granted for the permit or lane closure if the permittee is unable to finish the work by the date authorized. A request for an extension must be made in writing to the street maintenance engineer at least24 hours prior to the date the excavation is to be completed as shown on the permit. The request must state the specific reasons an extension is being requested. Failure to complete work within the time period allotted for the permit or for lane closure, as extended as provided herein, will result in penalties being assessed by the city to the permittee as follows: $100.00 per day for work on major streets and $50.00 per day for work on local streets. Extensions may be granted for, but are not limited to, inclement weather, special order of repair material, or unforeseen complications resulting in additional time necessary to repair the excavated facilities.

 

Should an eligible person fail to secure a permit prior to commencing excavation, the city shall assess a penalty to such person in the amount of $100.00 per day. Such penalty shall continue to accrue up until the day that a permit is secured.

 

Section 2. That Omaha Municipal Code Section 34-57 as heretofore existing is hereby repealed.

 

Section 3. That this Ordinance shall be in full force and take effect 15 days from and after the date of its passage.

SPECIAL ORDINANCE NO. 10279

AN ORDINANCE levying a special tax assessment for cutting and clearing weeds, grass and worthless vegetation in accordance with Sections 18-21 through 18-30 of the Omaha Municipal Code on certain lots in the City of Omaha. WHEREAS, it having been and being hereby adjudged, determined and established that several lots and pieces of real estate, hereafter referred to, have each been specially benefited to the full amount herein levied and assessed against each of said lots and pieces of real estate respectively, by reason of cutting and clearing weeds, grass and worthless vegetation thereon, by the City of Omaha. THEREFORE, for the purpose of paying the incurred cost of weed, grass and worthless vegetation cutting work. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That said cost of weeds, grass and worthless vegetation cutting work by the City of Omaha during the interim date, January 1, 2019 through December 31, 2019, on Group No. 2020-08, said cost being the sum of one thousand two hundred thirty two dollars ($1,232.00), be and the same hereby is levied and assessed in proportion and according to incurred costs and special benefits by reason of said improvement upon the following described lots and real estate within the City of Omaha, as shown by the generally recognized maps, plats and records on file in the office of the City Engineer of the City, said cost being so levied on said lots and real estate, respectively, as set forth as follows: Section 2. That said special taxes levied aforesaid on said lots, respectively, shall become delinquent per the “Monetary Table for Assessing” as follows:

Where the individual assessment is Four Hundred Ninety Nine and 99/100 Dollars ($499.99) or less the total amount shall become delinquent fifty (50) days from and after the passage and approval of this Ordinance. Interest at the rate of fourteen percent per annum, as provided by State law, payable in advance shall be paid on each delinquent installment or on each delinquent assessment of Four Hundred Ninety Nine and 99/100 Dollars ($499.99) or less. Section 3. That the entire amount of tax so levied and assessed on any of said lots or pieces of real estate may be paid by the owners thereof or by any person within fifty (50) days from said levy and thereupon said lots or parts of lots shall be exempt from lien or charge thereto. Section 4. This Ordinance shall be in full force and take effect fifteen (15) days from and after its passage.

AN ORDINANCE levying a special tax assessment for litter removal in accordance with Sections 18-21 through 18-30 of the Omaha Municipal Code on certain lots in the City of Omaha. WHEREAS, it having been and being hereby adjudged, determined and established that several lots and pieces of real estate, hereafter referred to, have each been specially benefited to the full amount herein levied and assessed against each of said lots and pieces of real estate respectively, by reason of litter removal thereon, by the City of Omaha. THEREFORE, for the purpose of paying the incurred cost of litter removal work. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That said cost of litter removal work by the City of Omaha during the interim date, January 1, 2019 through December 31, 2019, on Group No. 2020-09, said cost being the sum of six thousand seven hundred fifty nine dollars ($6,759.00), be and the same hereby is levied and assessed in proportion and according to incurred costs and special benefits by reason of said improvement upon the following described lots and real estate within the City of Omaha, as shown by the generally recognized maps, plats and records on file in the office of the City Engineer of the City, said cost being so levied on said lots and real estate, respectively, as set forth as follows: Section 2. ORDINANCE NO. 42269

AN ORDINANCE authorizing the approval of the Service Agreement between the City of Omaha, Nebraska, on behalf of the Omaha Police Department (OPD), and ldemia Identity and Security USA, LLC (IDEMIA), a Delaware limited liability corporation, to lease an IDEMIA Ruggedized LiveScan Station for digital fingerprinting, for a term of five years with the option to renew for an-other five years, and can be done so administratively; that in consideration, the City shall pay IDEMIA $13,028.00 over the five-year period; payment will be made by the Nebraska State Patrol for Year 2020, and payments in the amount of $3,257.00 will be made by OPD for Year 2021, 2022, 2023, and 2024; and to provide an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the attached Agreement between the City of Omaha, Nebraska, on behalf of the Omaha Police Department, and ldemia Identity and Security USA, LLC, a Delaware limited liability corporation, to lease an IDEMIA Ruggedized LiveScan Station for digital fingerprinting, for a term of five years with the option to renew for an-other five years, is hereby accepted and approved. Section 2. In consideration, the City shall pay IDEMIA $13,028.00 over a five-year period; payment will be made by the Nebraska State Patrol for Year 2020, and payments in the amount of $3,257.00 will be made by OPD for Year 2021, 2022, 2023, and 2024. Section 3. That this Ordinance, not being of legislative character, shall be in full force and take effect upon its passage.

ORDINANCE NO. 42270

AN ORDINANCE to approve the acceptance of and authorize disbursement over more than one fiscal year from the Nebraska Crime Commission, FY 2019 STOP Violence Against Women (VAWA) Grant, Award #2019-WF-AX-0004 ($221,471) and Award #2017-WF-AX-0004 ($24,644.45) in the amount of two hundred and for-ty-six thousand, one hundred and fifteen dollars and forty-five cents ($246, 115.45), with a match of sixty-six thousand four-hundred ninety-one dollars ($66,491) during the project period of July 1, 2020 to June 30, 2021; to enhance victim assistance services and prosecute cases of domestic violence through the multi-agency Douglas County Community Response Team as detailed in the attached grant application; to authorize payment from such grant funding and involving appropriations of more than one fiscal year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date thereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That, as recommended by the Mayor, the acceptance of and disburse-ment from the Nebraska Crime Commission, FY 2018 STOP Violence Against Women (VAWA) Grant, Award #2019-WF-AX-0004 ($221,471) and Award #2017-WF-AX-0004 ($24,644.45) in the amount of two hundred and forty-six thousand, one hundred and fifteen dollars and forty-five cents ($246,115.45), during the project pe-riod of July 1, 2020 to June 30, 2021 to provide funding for the implementation of the Douglas County Commu-nity Response Team, is hereby approved. Section 2. A copy of such grant award, special conditions, grant applica-tion, and revised budget and budget narrative are attached by this reference and made a part hereof. Section 3. That, the grant period extends from July 1, 2020 to June 30, 2021, commencing upon approval of this ordinance. In conformity with Section 5.17 of the Home Rule Charter, approval of this Ordinance, involving appropriations of more than one year from receipt of grant funds and expenditures, is hereby authorized. Section 4. That, there is a match of $66,491 with this grant award, provided by the Omaha Police Department ($29,667) and the Douglas County Attorney’s Office ($36,824). Section 5. That, this Ordinance, being administrative and not legislative in character, shall be in full force and take effect immediately upon passage.
