Mayor Zac Johns called the regular monthly meeting to order on Monday, August 14, 2023 at 6:00 p.m. In attendance were City Council Members Clint Adams, Kaye Bridgeford, Josh Dowding and Shane Pekny. Mindi Laaker identified the Open Meetings Act location that is available to the public.

OPPD Representative Michaela Valentin
Valentin introduced herself as a Government Representative and spoke of the utility company’s growth.
Ordinance No. 521 Amending the City of Bennington’s Subdivision Regulations
City Engineer Julie Ogden presented the proposed changes to the City Subdivision Regulations.
Johns opened a public hearing and there were no comments.
Motion by Bridgeford, second by Dowding to introduce and waive three readings of Ordinance No. 521 AN ORDINANCE AMENDING THE CITY OF BENNINGTON SUBDIVISION REGULATIONS. All voted in favor and the motion carried.
Motion by Pekny, second by Dowding to approve and adopt Ordinance No. 521. All voted in favor and the motion carried.
Street Closures and Event Applications
Motion by Dowding, second by Bridgeford to approve the street closure and event application for an Antique Tractor Show – Douglas County Farm Bureau on Saturday August 19, from 8 a.m. to 1 p.m. All voted in favor and the motion carried.
Motion by Pekny, second by Bridgeford to approve a Trunk & Treat - Sons of the American Legion on Saturday October 28, from 5:30 p.m. to 9 p.m. All voted in favor and the motion carried.
Peddlers Permit Application
Motion by Dowding, second by Adams to approve Everlight Solar for door-to-door sales for one week September 4-9, 2023. All voted in favor and the motion carried.
Ordinance No. 522 Rezoning the land located in the West Half of S15, T16N, R11E being Platted as the Water’s Edge @ 168 Subdivision Lots 1-88 and Outlots A-F, from a TA Transitional Agriculture Zoning District to an R-4 High Density Residential Zoning District
Motion by Bridgeford, second by Dowding to introduce and waive three readings of Ordinance No. 522 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP AS ADOPTED BY CITY OF BENNINGTON ZONING REGULATION 3.02 VIA CITY OF BENNINGTON ORDINANCE NO. 460 FROM A TA TRANSITIONAL AGRICULTURE ZONING DISTRICT TO AN R-4 HIGH DENSITY RESIDENTIAL ZONING DISTRICT FOR THE LAND BEING PLATTED AS THE WATER’S EDGE @ 168 SUBDIVISION LOTS 1-88 AND OUTLOTS A-F, LOCATED IN THE WEST HALF OF SECTION 15, TOWNSHIP 16 NORTH, RANGE 11 EAST OF THE 6TH P.M., DOUGLAS COUNTY, NEBRASKA. All voted in favor and the motion carried.

Ordinance No. 523 Rezoning the land located in the North Half of S15, T16N, R11E being Platted as the Kempten Creek Phase 2 Subdivision Lots 205-257 and Outlots K and M, from a TA Transitional Agriculture Zoning District to an R-3 Medium Density Residential Zoning District
Motion by Pekny, second by Dowding to introduce and waive three readings of Ordinance No. 523 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP AS ADOPTED BY CITY OF BENNINGTON ZONING REGULATION 3.02 VIA CITY OF BENNINGTON ORDINANCE NO. 460 FROM A TA TRANSITIONAL AGRICULTURE ZONING DISTRICT TO AN R-3 MEDIUM DENSITY RESIDENTIAL ZONING DISTRICT FOR THE LAND BEING PLATTED AS THE KEMPTEN CREEK PHASE 2 SUBDIVISION LOTS 206-257 AND OUTLOTS K AND M, LOCATED IN THE NORTH HALF OF SECTION 15, TOWNSHIP 16 NORTH, RANGE 11 EAST OF THE 6TH P.M., DOUGLAS COUNTY, NEBRASKA.
Motion by Pekny, second by Dowding to approve and adopt Ordinance No. 523. All voted in favor and the motion carried.
Warehouse Street and Sewer Improvements
ME Collins Pay Application #3 totaling $161,941.75
ME Collins Change Order No. 1 Removing Unsuitable Soils between Harvest Lane and Stark Street totaling $75,004.60
Thiele Geotech Inc. Invoice No. 80550 totaling $1,562.00
Motion by Bridgeford, second by Dowding to approve payment of Items A-C listed above. All voted in favor and the motion carried.
City Engineer updated the City Council on project phasing and schedule changes including full-width paving.
Neumeyer Farm Park
Motion by Pekny, second by Dowding to approve The Olsson Studio Letter Agreement Amendment #2 totaling $16,960.00 for materials testing. All voted in favor and the motion carried.
Motion by Adams, second by Pekny to approve Blade Master Change Order No. 2 adding a culvert pipe to facilitate drainage totaling $11,833.00. All voted in favor and the motion carried.
2023-2024 Budget Review
Changes were discussed.
Review One & Six Year Street Plan
A draft One & Six Year Street Plan was reviewed in preparation for approval at the September Council meeting.
Planning Commission Member Nomination Karen Hohman
Motion by Pekny, second by Dowding to approve the appointment of Karen Hohman to the Planning Commission. All voted in favor and the motion carried.
Library, Police, Public Works, Office and Project Tracker Reports
All monthly reports are on file in the City Office.
Public Comments – Information was presented regarding a proposed industrial development including traffic located in the area of Highway 36 and Bennington Road.
Executive Session
Mayor Johns stated that an executive session would be held with respect to a Strategy Session with the City Attorney on Contract Negotiations.
Motion by Bridgeford, second by Adams to go into Executive Session for purpose of contract negotiations at 6:52 p.m. All voted in favor and the motion carried.
Motion by Bridgeford, second by Adams to reconvene in open session at 7:09 p.m. All voted in favor and the motion carried.

Mayor Zac Johns called the budget meeting to order on Monday, August 21, 2023 at 6:07 p.m. In attendance were City Council Members Clint Adams, Kaye Bridgeford, Josh Dowding and Shane Pekny. Mindi Laaker identified the Open Meetings Act location that is available to the public.
Budget Presentations, Discussions and Review
Mayor Zac Johns and City Council Members reviewed the budget with City Auditor Gene Garrelts and Department Heads. Conversations focused on park and street equipment, a new public works building and the levy.

Motion by Johns, second by Bridgeford to adjourn the meeting at 6:46 p.m. All voted in favor and the motion carried.
