Notice is hereby given that the City Council of the City of Omaha met on January 24, 2023 and passed and approved the following ordinances:

ORDINANCE NO. 43253

AN ORDINANCE to amend the boundaries of the MCC-Major Commercial Corridor Overlay District, to incorporate into that district the property located northwest of 107th Avenue and Pacific Street; and to provide for an effective date.

Summary: In accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lots 1-4, Regency Landing, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned to be included in and incorporated into the MCC-Major Commercial Corridor Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance.

ORDINANCE NO. 43254

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located southeast of 204th and Q Streets from AG-Agricultural District to DR-Development Reserve District.

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Outlots A through S, South Streams, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG-Agricultural District to DR-Development Reserve District.

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located southeast of 204th and Q Streets from AG-Agricultural District to R4-Single-Family Residential District (High-Density).

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 1-119, 152-184, and 205-233, South Streams, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG-Agricultural District to R4-Single-Family Residential District (High-Density).

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 120-144, 145-151, 185-204 and 234, South Streams, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG-Agricultural District to R5-Urban Family Residential District.

AN ORDINANCE to approve a Pedestrian Bridge Maintenance Agreement among the City of Omaha, New West Farm Holdings, LLC, a Nebraska limited liability company, Sanitary and Improvement District (S.&1.D.) 583 of Douglas County, Nebraska, and the Heartwood Preserve Master Property Owners Association, a Nebraska not for profit corporation, concerning the allowable pedestrian bridge improvements in the right-of-way and the private maintenance and liability obligations thereof for the pedestrian bridge over Pacific Street, located between Applied Parkway and 151st Street; to authorize the execution of said Agreement; and to provide an effective date thereof.

AN ORDINANCE to approve the acceptance of and authorize disbursement over more than one fiscal year from the U.S. Department of Housing and Urban Development, Office of Lead Hazard Control and Healthy Homes, FY 2022 Lead-Based Paint Hazard Reduction Grant, Award #NELHD0489-22, in the amount of three million, seven hundred and seven thousand, three hundred and fifty-five dollars ($3,707,355.00), match in the amount of six hundred and twenty-five thousand dollars ($625,000.00), and total program amount of four million, three hundred and thirty-two thousand, three hundred and fifty-five dollars ($4,332,355.00), during the project period extending from December 15, 2022 to December 15, 2026; to provide funding for lead hazard control services for up to 160 housing units in targeted areas of substandard housing; to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, providing for the effective date hereof.

AN ORDINANCE to approve and execute an Agreement involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of the City of Omaha, 1956, as amended, by and between the City of Omaha, a Municipal Corporation and Ameritas Life Insurance Corp. to provide administrative services for the City’s self-insured dental plan for a period of thirty-six (36) months commencing on January 1, 2023, and ending on December 31, 2025 with two additional one (1) year City options, in accordance with the lowest and best proposal submitted by said Ameritas Life Insurance Corp.; to authorize the Finance Director to make payments to Ameritas Life Insurance Corp. in accordance with such Contract; and to provide the effective date thereof.

AN ORDINANCE to approve the attached proposal for group long term disability insurance with Mutual of Omaha as submitted in a response to a Request for Proposals (RFP) issued by the City of Omaha; to provide group long term disability insurance for full-time classified and unclassified employees of the AEC, Functional, CMPTEC, and Civilian Bargaining groups, Department Directors and elected officials beginning January 1, 2023 for a three year period ending on December 31, 2025, to authorize the Mayor to execute and the City Clerk to attest any documents required to move forward with such proposal; to authorize payment for such group long term disability insurance in the amount of $130,938 per year for the years 2023, 2024 and 2025 from General Fund 11111, Organization 118018, Account 41331; and involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of the City of Omaha, 1956, as amended, and to provide an effective date.

AIR QUALITY CONTROL

Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of BMaKK to renew their operating permit for the concrete crushing facility at 1440 Read Street, Omaha. The potential emissions, in tons, for this facility are: TSP 99.3, PM10 29.5 and PM2.5 6.1.

No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.

All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from February 1, 2023 to March 3, 2023. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position.  The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.  Comments should be mailed to:
