Notice is hereby given that the City Council of the City of Omaha met on March 16, 2021 and passed and approved the following ordinances:

ORDINANCE NO. 42462

AN ORDINANCE to approve an Amendment to the Future Land Use Element of the Master Plan for the City of Omaha, to reclassify the intersection of 204th and F Streets from a Convenience Mixed Use Area (10 acres) to a Neighborhood Mixed Use Area (30 acres), along with approval of a 20 percent variance to allow up to 36 acres of mixed use development located southwest of 204th and F Streets; and to provide for an effective date hereof.

Summary: Section 7.05 of the Charter of the City of Omaha allows for the City Council to adopt amendments to the City’s Master Plan as deemed necessary and appropriate upon recommendation by the Planning Board.

ORDINANCE NO. 42463

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located southwest of 144th Street and West Dodge Road from R4-Single-Family Residential District, R7-Medium-Density Multiple-Family Residential District and MU-Mixed Use District to R4-Single-Family Residential District.

Summary:  The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 26, West Farm Replat 7, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from R4-Single-Family Residential District, R7-Medium-Density Multiple-Family Residential District and MU-Mixed Use District to R4-Single-Family Residential District.

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located southwest of 144th Street and West Dodge Road from R4-Single-Family Residential District, R7-Medium-Density Multiple-Family Residential District and MU-Mixed Use District to R7-Medium-Density Multiple-Family Residential District.

Summary:  The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 22 through 25, West Farm Replat 7, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from R4-Single-Family Residential District, R7-Medium-Density Multiple-Family Residential District and MU-Mixed Use District to R7-Medium-Density Multiple-Family Residential District.

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located southwest of 144th Street and West Dodge Road from R4-Single-Family Residential District, R7-Medium-Density Multiple-Family Residential District and MU-Mixed Use District to MU-Mixed Use District.

Summary:  The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 1 through 21 and Lots 27 through 40, West Farm Replat 7, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from R4-Single-Family Residential District, R7-Medium-Density Multiple-Family Residential District and MU-Mixed Use District to MU-Mixed Use District.

ORDINANCE NO. 42466

AN ORDINANCE to approve a Major Amendment to a Mixed Use District Development Agreement between the City of Omaha and New West Farm Holdings, LLC for West Farm, located southwest of 144th Street and West Dodge Road, to allow changes to the building height limitations on properties within the proposed mixed use plan, providing site development standards; and to provide for an effective date.

Summary:  That the City of Omaha, in the interest of maintaining public health, safety, and welfare, desires to assure the property located southwest of 144th Street and West Dodge Road is developed in accordance with the provisions of the Major Amendment to a Mixed Use Development Agreement attached hereto and made a part hereof by reference.

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone prope1ty located southwest of 180th Street and West Maple Road from AG-Agricultural District and DR-Development Reserve District to MU-Mixed Use District.

Summary:  The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 12-20 and Outlots F-I, Antler View East, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG-Agricultural District and DR-Development Reserve District to MU-Mixed Use District.

ORDINANCE NO. 42468

AN ORDINANCE to approve a Major Amendment to a Mixed Use District Development Agreement for Antler View East, located southwest of 180th Street and West Maple Road, to include a request for a bufferyard waiver for the building on Lot 2 from 30’ to 25 ‘, the addition of Lot 20 and its associated office building, the expansion of Lot 18 to incorporate Outlot C, moving the parking areas on Lots 4-8 and 12-l 6 from the rear to the front of each respective building, and a change in use type from Office to Retail on Lots 14-15, between the City of Omaha and 180 Maple LLC, providing site development standards; and to provide for an effective date.

Summary:  That the City of Omaha, in the interest of maintaining public health safety, and welfare, desires to assure that the property located southwest of 180th Street and West Maple Road is developed in accordance with the provisions of the Major Amendment to a Mixed Use District Development Agreement attached hereto and made a part hereof by reference.

ORDINANCE NO. 42457

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 2408 Maple Street from RS-Urban Family Residential District and R7-Medium-Density Multiple-Family Residential District to RS-Urban Family Residential District.

Summary:  The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: LOT 4 BLOCK 1 W 30 FT LOTS 1 THRU 3 & ALL LOT 4 80X120, PATRICKS A S ADD, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from RS-Urban Family Residential District and R7-Medium-Density Multiple-Family Residential District to RS-Urban Family Residential District.

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located at 3803, 3811 Corby Street from R4(35)-Single-Family Residential District (High-Density) to R4-Single-Family Residential District (High-Density).

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 1 and 3, Block 13, Hitchcock’s 1st Addition, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from R4(35)-Single-Family Residential District (High-Density) to R4-Single-Family Residential District (High-Density).

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 4, 19 and 20, Block 13, Hitchcock’s 1st Addition, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, is hereby rezoned from R4(35)-Single-Family Residential District (High-Density) to R4-Single-Family Residential District (High-Density).

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 15, South Side Acres, a subdivision, surveyed and recorded in Douglas County, Nebraska, is hereby rezoned from DR-Development Reserve to R3-Single-Family Residential District (Medium-Density).

ORDINANCE NO. 42461

AN ORDINANCE to amend the boundaries of the MCC-Major Commercial Corridor Overlay District, to incorporate into that district the property located northeast of 138th and P Streets; and to provide for an effective date.

Summary: In accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lots 1 and 2, Landmark Plaza Replat 1, a subdivision in Douglas County, Nebraska is hereby rezoned to be included in and incorporated into the MCC-Major Commercial Corridor Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance.

AN ORDINANCE to approve a Major Amendment to a Mixed Use District Development Agreement between the City of Omaha and 85 Seabees, LLC for Flanagan Pointe, located northeast of 180th and Fort Streets, to allow 350 apartment units, exceeding the 250 apartment unit limit established in the Omaha Master Plan for this size Mixed Use Area, providing site development standards; and to provide for an effective date.

Summary: That the City of Omaha, in the interest of maintaining public health, safety, and welfare, desires to assure the property located northeast of 180th and Fort Streets is developed in accordance with the provisions of the Major Amendment to a Mixed Use Development Agreement attached hereto and made a part hereof by reference.

ORDINANCE NO. 42470

AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and 1701, LLC, a Nebraska limited liability company, to implement the NAAF Habitat Project 7 Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project area generally bound by Sahler Street on the north, Pratt Street on the south, 24 Street on the east and 27 Street on the west, which provides for the construction of twenty (20) single-family homes; the agreement authorizes the use of up to $440,000.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date.

AN ORDINANCE to accept the bid of Chesterman Company to provide vending concession products and services to various locations commencing of March 1, 2021. The City reserves the right to extend this contract for a five (5) year term at the sole option of the City, to authorize payment in accordance therewith; to authorize the Purchasing Agent to issue a purchase order in the total amount of $52,200.00, plus 35% commission on the sale of products; and to provide an effective date.

ORDINANCE NO. 42472

AN ORDINANCE providing for an amendment to the levy of a general business occupation tax as requested by the property owner(s) of the Landmark Building, Avaden Landmark, LLC; and related matters.

Summary: Pursuant to Neb. Rev. Stat. Chapter 18, Article 21, as amended, Chapter 19 of the Omaha Municipal Code, and Ordinance No. 41592, as amended by Ordinance No. 42472, the City Council established an enhanced employment area for the purpose of paying all or any part of the costs and expenses of a redevelopment project pursuant to the approved Landmark Building Tax Increment Financing Redevelopment Project Plan, which, in part, provides for the conversion of six floors of a significantly vacant, 15-story, Class “A” Office building known as the Landmark Building into an upscale boutique hotel, a two-story restaurant with rooftop seating, courtyard and façade improvements, and other improvements within the area.
