Notice is hereby given that the City Council of the City of Omaha met on April 9, 2024 and passed and approved the following ordinances:

 

ORDINANCE NO. 43773

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located south of 230th Street and Edgewater Road from AG-Agricultural District to DR-Development Reserve District.

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 1, Schuler Addition, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska are hereby rezoned from AG-Agricultural District to DR-Development Reserve District.

ORDINANCE NO. 43774

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northwest of Skyline Drive and Old Center Road from AG-Agricultural District to R4-Single-Family Residential District (High-Density).

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 1-2, SONNENTANZ, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG-Agricultural District to R4-Single-Family Residential District (High-Density).

ORDINANCE NO. 43775

ORDINANCE NO. 43776

AN ORDINANCE to amend the boundaries of the ACI-2 Area of Civic Importance Overlay District, to incorporate into that district the property located at northwest of 30th Street and Sorensen Parkway; and to provide an effective date.

Summary: In accordance with Sections 55-609 through 55-617 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lot 1, Fort Omaha Expansion Replat 1, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned to be included in and incorporated into the ACI-2 Area of Civic Importance Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance.

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lot 3, Block 1, Paddock Place, in Douglas County, Nebraska, is hereby rezoned from GC-General Commercial District to R7-Medium-Density Multiple-Family Residential District.

ORDINANCE NO. 43772

AN ORDINANCE to amend the boundaries of the MCC-Major Commercial Corridor Overlay District, to incorporate into that district the property located at 12805 Fort Street; and to provide for an effective date.

Summary: ln accordance with Sections 55-681 through 55-688 and 55-886 of the Omaha Municipal Code, the official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended so that: Lot 1, Iron Ridge Replat 2, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska is hereby rezoned to be included in and incorporated into the MCC-Major Commercial Corridor Overlay District; provided, that the base zoning district for such property shall not be changed by this ordinance.

ORDINANCE NO. 43777

AN ORDINANCE to amend Ordinance No. 41621, which accepted a price agreement with B&W Co., Inc. for machine street sweeping services, to amend the agreement to include the first extension being a three (3) year extension from 2024 to 2026 and a second extension being a two (2) year extension from 2027 to 2028 at the City’s sole discretion, and to accept price increases; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from a specific account; and to provide an effective date hereof.

AN ORDINANCE authorizing the issuance of a purchase order to Bordova Innovations, Inc. in the amount of $50,000.00, for the purchase of uniforms to be utilized by the Street Maintenance Division, to be effective for a period of 12 months and is extendable for three (3) one-year periods at the City’s own option; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from a specific account; and to provide an effective date hereof.

ORDINANCE NO. 43780

AN ORDINANCE rescinding Ordinance No. 42507, passed by the Omaha City Council on April 20, 2021 approving a Tax Increment Financing (TIF) Redevelopment Loan Agreement with 27LeavenworthOwner, LLC, a Nebraska limited liability company to implement the 27Leavenworth Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 2615 Leavenworth Street, 2612 Marcy Street, 819 South 27th Street and 815 South 27th Street, which proposed for the construction of a five (5) story apartment building with 134 units and included 86 parking stalls in the structure plus 14 off-site parking stalls, and providing for an effective date.

ORDINANCE NO. 43781

AN ORDINANCE to approve a Second Amendment to the Redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and 1609 Binney1, LLC, a Nebraska limited liability company, which was approved by Ordinance No. 41390 on January 30, 2018, and executed by the Mayor of the City of Omaha on February 5, 2018, and subsequently amended administratively on January 9, 2020. This Second Amendment to the Redevelopment Agreement changes the intended use of the building at 2922 North 16th Street from commercial to residential which will contain four affordable apartment units rather than the single commercial tenant bay that was approved in the initial TIF application.

AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and 807 Development, LLC, a Nebraska limited liability company, to implement the Walter Apartments Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 807 South 50th Street, which proposes the demolition of the existing building on the site and the construction of a new five story apartment building with 58 market rate units; the agreement authorizes the use of up to $1,938,647.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date.

AN ORDINANCE to accept the bid of Miller & Sons Golf Cars in the total amount of $291,744.00 for the lease of seventy-two (72) gas-powered golf cars for the Golf Division of the Parks, Recreation and Public Property Department; for four (4) years with the lease commencing when approved by the City Council 2024, through April 2027, to authorize annual payments as specified therein in the amount of $72,936.00 per year, for a total amount of $291,744.00.

AN ORDINANCE approving Amendment No. 1 to Agreement for Fire and Emergency Services Nebraska Interlocal Co-Operation Act Elkhorn Suburban Fire Protection District, # 2 and the City of Omaha which provides that the Elkhorn Suburban Fire Protection District #2 will purchase a water tender truck from the North Platte Fire Department for the sum of $190,000 and transfer title to the truck to the City of Omaha which will satisfy its obligation to make annual payments of $40,000 per year to the City of Omaha for public education and fire prevention services; and provide an effective date hereof.
