AIR QUALITY CONTROL

Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of Omaha Public Power District to renew their operating permit for the electrical generation facility at 7475 Pershing Drive, Omaha. The potential emissions, in tons, for this facility are: TSP 659.5, PM10 524.7, PM2.5 376.3, SOx 13,906, NOx 9,149, VOC 160.0, CO 1309, Lead 0.07, Ammonia 93.1, Acrolein 0.3, Arsenic 0.02, Benzene 1.2, Benzyl Chloride 0.7, Cadmium 0.03, Cyanide 2.3, Dioctyl Phthalate 0.07, Dimethyl Sulfate 0.04, Hexane 52.4, Hydrogen Chloride 49.0, Hydrogen Fluoride 83.6, Mercury 0.02, Methyl Hydrazine 0.16, Selenium 1.1 and CO2 equivalent 4,962,349.

No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.

All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from April 21, 2021 to May 21, 2021. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position.  The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.  Comments should be mailed to:

Notice is hereby given that the City Council of the City of Omaha met on April 13, 2021 and passed and approved the following ordinances:

ORDINANCE NO. 42487

AN ORDINANCE to amend the official zoning map of the City of Omaha adopted by Section 55-65 of the Omaha Municipal Code, by changing certain boundaries of the official zoning map of the City of Omaha in accordance with Section 55-886 of the Omaha Municipal Code, to rezone property located northwest of 210th and Fort Streets from AG-Agricultural District and DR-Development Reserve District to R4-Single-Family Residential District (High Density).

Summary: The official zoning map adopted by Section 55-65 of the Omaha Municipal Code be, and the same hereby is, changed and amended in accordance with Section 55-886 of the Omaha Municipal Code so that: Lots 513 through 523, Vistancia, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, are hereby rezoned from AG-Agricultural District and DR-Development Reserve District to R4-Single-Family Residential District (High Density).

ORDINANCE NO. 42492

AN ORDINANCE establishing the South Omaha Business Improvement District (BID No. 6880) under the authority of the Business Improvement District Act, Neb.Rev.Stat.§ 19-4105, et seq. for the purpose of providing specified activities, work and improvements in the City of Omaha, Nebraska; to create the South Omaha Business Improvement District; to define the boundaries of such District; to identify that the properties benefited by the streetscape improvements will be subject to special assessments in accordance with the South Omaha Business Improvement District Plan; to provide for special assessment in an approximate amount of up to $30,000 in year one for general maintenance and infrastructure improvement, landscaping, water costs, street cleaning, and promotion; to be imposed upon such District based upon the benefits conferred; to provide for the assessment of property specially benefited within the District; to provide a method of assessment to be assessed upon properties specially benefited by the District; and to provide the effective date hereof. WHEREAS, there has been a request by the South Omaha Business Improvement District Area Board that the City Council of the City of Omaha establish an Improvement District providing specified work and improvements as described herein; and, WHEREAS, in accordance with Neb.Rev.Stat. § 19-4015 to§ 19-4038 (Reissue 2018 Cumm. Supp.), such improvements may be made as cited in the Business Improvement District Act; and, WHEREAS, the City Council, following a public hearing may establish or reject the proposed business improvement district.

ORDINANCE NO. 42495

AN ORDINANCE approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Elkhorn Landing, LLC, a Nebraska limited liability company, to implement the Elkhorn Landing Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 20603 and 20605 Elkhorn Drive, which proposes construction of two new mixed use 3-story structures. The buildings will each contain 7 residential units on the upper floors (14 units, total) with office, retail and parking on the first floors and basement level. Approximately 25 parking stalls will be developed within the Elkhorn Drive right of way prior to occupancy of the first building; the agreement authorizes the use of up to $985,609.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date.
