NOTICE TO PUBLIC

     The regular meeting of the Board of Trustees of the Omaha Public Library will be held on Thursday, September 19, 2019 at 4:00 P.M. at the Bess Johnson Elkhorn Branch Library, located at 2100 Reading Plaza. Proposed agenda kept continually current is available in the Administrative Office at the W. Dale Clark Library.  The Board reserves the right to modify the agenda at said public meeting when convened.  Requests for sign language interpreters or other alternative formats will require a minimum of 48 hours advance notice.  Please contact the Administrative Office at (402) 444-4834 if arrangements need to be made.

CITY OF OMAHA

NOTICE TO PUBLIC

 

     The City Council of the City of Omaha will have a Pre-Council Meeting at 10:30 A.M. in the Conference Room, LC-1, Omaha/Douglas Civic Center, 1819 Farnam Street, for the purpose of discussing the agenda items and briefing and discussion of public business; and a regular Council Meeting at 2:00 P.M. on Tuesday, September 17, 2019, in the Legislative Chambers of the Omaha/Douglas Civic Center in Omaha, Nebraska.  Proposed agenda kept continually current shall be available for public inspection in the Omaha/Douglas Civic Center at the Office of the City Clerk, but the Council shall have the right to modify the agenda to include items of an emergency nature only at such public meeting when convened.

PUBLIC HEARING NOTICES

 

     NOTICE IS HEREBY GIVEN that the City Council of the City of Omaha, Nebraska, will hold public hearings on September 17, 2019, beginning at 2:00 PM in Legislative Chambers, 1819 Farnam Street, Omaha, Nebraska 68183, for the purpose of hearing testimony for:

 

     An ordinance to approve a five (5)-year agreement between Omaha Public Library and the City of Omaha, to forgive patron fines in exchange of non-expired canned goods and other non-perishable foods

 

     An ordinance in accordance with Section 5.10 of the Home Rule Charter of the City of Omaha, 1956, as amended, to transfer $2,425,480.00 in unencumbered appropriations in the 2019 Budget of the City of Omaha from the Wage Adjustment account to the City departments; and to fix the effective date hereof to be immediately upon passage in accordance with Section 2.12 of the Home Rule Charter of the City of Omaha, 1956, as amended

 

     An ordinance in accordance with Section 5.10 of the Home Rule Charter of the City of Omaha, 1956, as amended, to transfer $3,228,264.00 in unencumbered appropriations in the 2020 Budget of the City of Omaha from the Wage Adjustment account to the City departments; and to fix the effective date hereof to be immediately upon passage in accordance with Section 2.12 of the Home Rule Charter of the City of Omaha, 1956, as amended

 

     An ordinance in accordance with Section 5.10 of the Home Rule Charter of the City of Omaha, 1956, as amended, to transfer $738,070.00 in unencumbered appropriations in the 2020 Budget of the City of Omaha from the Wage Adjustment account to the City departments; and to fix the effective date hereof to be immediately upon passage in accordance with Section 2.12 of the Home Rule Charter of the City of Omaha, 1956, as amended

 

     An ordinance to amend Omaha Municipal Code Sec. 6-150; to provide that it is “unlawful for any person to bring any animal into the city which has, in another jurisdiction been judicially or administratively determined to be a dangerous, potentially dangerous, vicious, a nuisance, or a threat to the health or safety of human beings”

 

     An ordinance to approve the acceptance of the City of Omaha and Douglas County joint application to the U.S. Department of Justice (DOJ), Office of Justice Programs (OJP), Bureau of Justice Assistance (BJA), FY 2019 Edward Byrne Memorial Justice Assistance Grant (JAG) Program, Application #2019-H4362-NE-DJ, in the amount of three hundred seventy-four thousand seven hundred thirty-seven dollars ($374,737.00) for law enforcement programs, prevention and education programs, prosecution and court programs, corrections and community corrections programs, and planning, evaluation and technology improvement programs during the period of October 1, 2018 to September 30, 2022; to provide the Council an opportunity for review and public comment for such application; and upon award of such grant to authorize payment from such grant funding and involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter; and, to provide for the effective date hereof

 

     An ordinance authorizing the issuance of a purchase order to Todco Barricade for barricading services to be provided at various locations throughout the city; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from specific accounts; and to provide an effective date hereof

 

     An ordinance to approve an Agreement with Energy Center Omaha, LLC for supplying steamed and chilled water and related services to the W. Dale Clark Library for a period of ten years, subject to amendment and cancellation as specifically provided, with an initial steam consumption charge of $19.29 per 1,000 pounds and a chilled water rate varying from 27.78 cents per ton hour to 44.84 cents per ton hour; said contract providing for payments from appropriations out of more than one year in conformity with Section 5.17 of the Home Rule Charter from Library General Fund No. 11111, Organization No. 117026 (W. Dale Clark), 42531; and providing for the effective date hereof

     An ordinance to amend Chapter 32 of the Omaha Municipal Code: to amend Section 32-211 to clarify the intent of collection of Watershed Management Fees; amend Section 32-212 to change the criteria for collection of Watershed Management Fees; amend Section 32-213 to update watershed management fees for fiscal year 2020 to 2024; to repeal sections 32-211, 32-212, and 32-213 of the Omaha Municipal Code as heretofore existing, and to provide for the effective date hereof

 

     An ordinance to Amend Ordinance No. 41232 declaring the necessity of acquiring, for use by the City of Omaha, the necessary private property for the purpose of constructing the Missouri River Omaha Flood Protection Relief Wells project, identified as OPW 52534; providing that the City negotiate with the property owners for land acquisitions, permanent easements and temporary construction easements; providing that as to each specified parcel which cannot be obtained by negotiation, condemnation proceedings be undertaken and completed; and, providing for the effective date hereof

 

     An ordinance approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and PEKEDO, LLC, a Nebraska limited liability company, to implement the Elkhorn Station Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 2606 North Main Street, 2605 North 206th Street, and 20585 and 20575 Elkhorn Drive, which proposes the demolition of three existing structures for new construction of a four-story building along Main Street with retail and office uses on the lower level and a mix of one and two-bedroom market-rate apartment units on the upper three floors, and new construction of a four-story building on the western portion of the site with retail and office uses and garage parking stalls on the main level and a mix of one and two bedroom apartment units on the three upper levels, for a total of 90 apartment units, 94 surface stalls, 90 garaged parking stalls, and additional public surface parking in the unimproved North 216th Street and adjacent rail right-of-ways; the agreement authorizes the use of up to $3,200,000.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date

 

     An ordinance approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and 1402 Howard, LLC, a Nebraska limited liability company, to implement the 14 Howard Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located at 1402 and 1410 Howard Street, which proposes the rehabilitation of the two-story building on 1410 Howard Street, and demolition of the building on 1402 Howard Street to allow new construction of a mixed-use building, to be connected and function as a single facility, with approximately 6,650 square feet for restaurant and bar use, 3,114 square feet for retail use, 6,284 square feet for office use and 4,224 square feet for storage space; the agreement authorizes the use of up to $475,000.00, plus accrued interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, with the applicant contributing $10,000.00 of the TIF loan proceeds toward the Downtown Public Improvement Fund, and providing for an effective date

 

     An ordinance approving a Second Amendment to the Redevelopment Agreement between the City of Omaha and Alchemy Development, LLC, a Nebraska limited liability company, which was approved by City of Omaha Council Ordinance No. 41242 on September 12, 2017, executed by the Mayor of the City of Omaha on September 14, 2017, and administratively amended on June 7, 2018, to change the final assessed valuation, base and division years, total project cost and amount of Tax Increment Financing (TIF) loan proceeds requested for the Zone 6 Apartments at Aksarben Village Tax Increment Financing (TIF) Redevelopment Agreement, as amended, authorizing an additional TIF loan allocation of $484,732.00, plus accrued interest, thereby increasing the original TIF loan proceeds from $1,625,568.00 to $2,110,300.00, plus accrued interest, and revising the estimated total project cost to $19,113,500.00; and, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project, and providing for an effective date, all other terms and conditions contained in the Redevelopment Agreement not amended hereby, shall remain in full force and effect

 

     An ordinance to approve the acceptance of and authorize disbursement from the FY2019/2020 Douglas County Board of Commissioners’ Visitor Improvement Fund Grant in the amount of $110,000.00 during the project period of July 1, 2019 to June 30, 2020; to develop a new attraction along the riverfront at the Bob Kerrey Pedestrian Bridge as detailed in the attached grant application; to authorize the payments specified therein; and to provide an effective date

 

     An ordinance to amend Omaha Municipal Code Chapter 19, Article XVI, entitled “Restaurant and Drinking Places Occupational Privilege Tax,” by repealing Omaha Municipal Code Section 19-805; to reserve said section for future use

 

     An ordinance to amend Omaha Municipal Code Chapter 34, Article VI, Division 3, entitled “Removal of Obstructions and Accumulations;” by requiring the Public Works Department to annually establish the fee for Department personnel to clear ice and snow accumulations when an adjoining property owner fails to so, by modifying the existing Sections 34-331 through 34-334 and adding new Sections 34-335 through 34-339; to provide regulations, prohibitions, notice requirements, and penalties

    

     An ordinance approving an amendment to an agreement by and between the City of Omaha and Millwork District I, LLC, to complete the installation of Indiana Street between 11th and 13th Streets and increase the City’s expense allocation for the project to an amount not to exceed $1,100,000.00
