PUBLIC HEARING NOTICES

 

NOTICE IS HEREBY GIVEN that the City Council of the City of Omaha, Nebraska, will hold public hearings on November 25, 2025, beginning at 2:00 PM in Legislative Chambers, 1819 Farnam Street, Omaha, Nebraska 68183, for the purpose of hearing testimony for:

 

An ordinance approving the contract with Port-a-Johns dba Dale’s Trash Service, Inc. for 2026 Litter Can Collection services, for a period of three (3) years beginning January 1, 2026 through December 31, 2028, with the exclusive option by the City to extend the contract for up to two (2) one-year terms; to provide for payments from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of 1956, as amended; to provide for payments from a specific account.

 

An ordinance to approve a Storm Sewer Maintenance Agreement between the City of Omaha and Invest Omaha SC LLC, concerning the allowable storm sewer improvements in the right-of-way and on private property, and the private maintenance and liability obligations thereof for the CIP Saddle Creek Apartments site at 1012 South SaddleCreek; to authorize the execution of said Agreement.

 

An ordinance approving a redevelopment and Tax Increment Financing (TIF) Redevelopment Agreement between the City of Omaha and Ames Industrial Park, LLC, to implement the Charles Street Townhomes Tax Increment Financing (TIF) Redevelopment Project Plan for a redevelopment project site located west of 28th and Charles Streets, which proposes the construction of four (4) new residential market rate rental units consisting of two single family homes on the lots north of  Charles Street and two attached townhome style units on the lots on the south side of Charles Street; the agreement authorizes the use of up to $247,563.00, which includes capitalized interest, in excess ad valorem taxes (TIF) generated by the development to help fund the cost of the project.

 

An ordinance approving a Parking Lease Agreement between the City of Omaha and River North Transit, LLC, dba Via for the lease of eight (8) parking spaces at Hitchcock Park.

 

An ordinance approving the Second Amendment to the Cell Site License Agreement between the City of Omaha and Omaha Cellular Telephone Company, dba Verizon Wireless, for a period of five (5) years with five (5) additional five-year options, to maintain and operate communications equipment on a portion of the premises contained within Tranquility Park.

 

An ordinance approving the Cumulative Final Work Authorization #9 – Establishment of Binding Guaranteed Maximum Price (“GMP”) from Hausmann Construction, Inc., for the construction of Levi Carter Park Activity and Sports Complex.

 

An ordinance levying a special tax assessment for litter removal in accordance with Sections 18-21 through 18-30 of the Omaha Municipal Code on certain lots in the City of Omaha – Group 2026-01.

 

An ordinance levying a special tax assessment for cutting and clearing weeds, grass and worthless vegetation in accordance with Sections 18-21 through 18-30 of the Omaha Municipal Code on certain lots in the City of Omaha – Group 2026-02.

 

An ordinance levying a special tax assessment for the removal and/or trimming of trees, bushes, shrubs, hedges, and any other vegetation in accordance with Sections 37-1 through 37-95 of the Omaha Municipal Code on certain lots in the City of Omaha – Group 2026-03.

 

An ordinance to accept the bid of Great Plains Uniforms LLC, involving the payment of money from appropriations of more than one year in accordance with Section 5.17 of the Home Rule Charter of the City of Omaha, 1956, as amended; to establish per item prices for two years on Omaha Police Department standard uniform items for use by members of the Omaha Police Department at an approximate cost of $1,231,873.75 for two years, which cost is based on estimated quantities which could vary; to authorize the Omaha Police Department to exercise its discretion as to the two one-year options with cost increases capped by the Consumer Price Index.

 

An ordinance to amend Section 23-177 of the Omaha Municipal Code concerning employment classifications by adding the employment classification entitled Crisis Support Specialist with a salary range of $60,944.00-$86,465.60; to repeal Section 23-177 as heretofore existing.

 

An ordinance to amend Section 23-177 of the Omaha Municipal Code concerning employment classifications by adding the employment classification entitled Engineering Technician III with a salary range of $79,622.40 to $113,318.40; to repeal Section 23-177 as heretofore existing.

 

An ordinance to amend Sections 23-177, 23-438, and 23-445 of the Omaha Municipal Code to reflect changes negotiated for the year 2026 through 2029 between the City of Omaha and the Functional Employees Group; to provide that any ordinances of the City of Omaha, and any rules and regulations promulgated thereunder, which are in conflict with this Ordinance shall not be applicable to those employees in the Functional Employees Group.

 

An ordinance to amend Sections 23-177, 23-181, 23-182, 23-365, 23-369, 23-403, 23-417, 23-462, 23-463, 23-468, 23-476 and to create Sections 23-374, 23-385, and 23-484 of the Omaha Municipal Code to reflect changes negotiated between the City of Omaha and the Civilian Management Professional and Technical Employees Council (CMPTEC) for the years 2026, 2027, 2028, and 2029; to provide for placement of             employees in the new pay plan; to provide that any ordinances of the City of Omaha, and any rules and regulations promulgated thereunder, which are in conflict with this Ordinance shall not be applicable to those employees in CMPTEC.

 

An ordinance (1) to approve an agreement between the City of Omaha and the Douglas County Board of Commissioners, Douglas County Administrative Office in the amount of $79,000.00; and (2) to authorize funding for such agreement from the City of Omaha’s FY 2024 STOP Violence Against Women (VAWA) Grant, Award #15JOVW-23-GG-00588-STOP Sub-Grant #197-2024-VW4016 Year Three, awarded by the Nebraska Crime Commission; to provide partial funding for one (1) full-time Misdemeanor Prosecutor and funding for one (1) full-time Liaison in the Douglas County Attorney’s Office Domestic Violence Prosecution Unit as part of the Douglas County Community Response Team; involving appropriations of more than one year in conformity with Section 5.17 of the Home Rule Charter.

 

An ordinance to amend section 44-151 of Chapter 44, Article V, Division 1 of the Omaha Municipal Code governing the City’s adoption of the 2023 version of the National Electrical Code.

 

An ordinance authorizing and directing an issue of general obligation bonds of the City of Omaha, Nebraska in the aggregate principal amount of not to exceed $75,000,000.00 to be termed for identification purposes “Various Purpose Bonds, Series 2025B”; prescribing the form of said bonds; authorizing the sale of said bonds by             negotiation; directing the preparation of a transcript of proceedings authorizing the issuance, sale and delivery of said bonds; appointing a Paying Agent and Registrar; approving the selection of an underwriter; directing that said bonds shall initially be issued and registered in book entry form; providing for continuing disclosure; delegating authority to an Authorized Officer to determine the final prices, interest rates, principal amounts and redemption provisions for said bonds.

 

An ordinance authorizing and providing for an issue of special tax revenue redevelopment bonds in one or more series and as tax-exempt or taxable obligations in the aggregate principal amount of not to exceed $3,300,000.00 to be termed for identification purposes “Special Tax Revenue Redevelopment Bonds, Series 2025” or such other designation or designations as shall be determined by an Authorized Officer of the City; prescribing the form and detail of said bonds; ratifying and confirming the creation of a community development agency; providing for the annual certification of the amount of community redevelopment tax to be levied for each succeeding fiscal year; pledging the special tax revenues to the payment of the principal of and interest on said bonds as the same fall due and to carry out all other covenants of this Ordinance; limiting the payment of said bonds solely to said special tax revenues; authorizing the sale of said bonds by negotiation; directing the preparation of a transcript of proceedings authorizing the issuance, sale and delivery of said bonds; appointing a Paying Agent and Registrar; approving the selection of an underwriter; directing that said bonds shall initially be issued and registered in book entry form; providing for continuing disclosure; delegating authority an Authorized Officer to determine the final prices, interest rates, principal amounts and redemption provisions for said bonds (Crossroads).

 

An ordinance authorizing and approving a Lease Purchase Agreement between the City of Omaha Public Facilities Corporation and the City of Omaha, Nebraska a copy of which Agreement is Exhibit A and incorporated herein by this reference, to provide funds for the lease-purchase of and the financing of the costs of acquiring (i) the Saddlecreek Parking Garage and related real property located on or near the University of Nebraska Medical Center’s campus located within the City, and (ii) the Ramp A Parking Garage and related real property located in the Midtown Crossing development located within the City; authorizing and approving one or more Site Lease Agreements between the Corporation and the City for the leasing of the project sites by the City to the Corporation, a copy of which Site Lease is Exhibit B and incorporated herein by this reference; approving an Indenture of Trust between the Corporation and BOKF, National Association, as Trustee and Paying Agent, a copy of which Indenture is Exhibit C and incorporated herein by this reference; approving the terms and conditions of the Corporation’s approximately $37,000,000.00 aggregate principal amount Lease Revenue Bonds, to be issued in one or more series and to be designated as either tax-exempt or taxable obligations as set forth in the Indenture and the issuance and delivery thereof; delegating authority to the City’s Finance Director to determine the number of series, final prices, interest rates, principal amounts, the tax-exempt or taxable status and redemption provisions for the Bonds; and satisfying applicable federal income tax law requirements for any series of bonds issued as tax-exempt obligations (Midtown and UNMC Parking Garages).

 

An ordinance authorizing and approving a Lease Purchase Agreement between the City of Omaha Public Facilities Corporation and the City of Omaha, Nebraska, to provide funds for the lease-purchase of and the financing of the costs of acquiring, constructing and equipping a sports arena facility; authorizing one or more Site Lease Agreements between the Corporation and the City for the ground leasing of the Project site by the City to the Corporation; authorizing and approving one or more Bills of Sale by the City to the Corporation for the sale of certain equipment to the Corporation; approving a Indenture of Trust between the Corporation and BOKF, National Association, as Trustee and Paying Agent; approving the terms and conditions of one or more series of the Corporation’s Lease Revenue Bonds in the aggregate principal amount of approximately $65,000,000.00, as set forth in the Indenture and the issuance and delivery thereof; delegating authority to the City Finance Director to determine for each series of Bonds authorized under such Ordinance, the final form of the Agreement, the Site Leases, the Bills of Sale and the Indenture, the final price, interest rates, principal amount, redemption provisions, and other terms and conditions thereof; and satisfying applicable federal income tax law requirements (Tranquility Park).

 

An ordinance authorizing and providing for the issuance of Redevelopment Project Revenue Bonds (Affordable Housing Urban Core) in one or more series in an aggregate principal amount not to exceed $40,000,000.00, for the purpose of (1) funding the costs of reconstructing, improving, extending, rehabilitating, installing, equipping, furnishing and completing certain improvements for affordable housing within the Redevelopment Project Plan Area, and (2) paying the costs of issuance of such bonds; prescribing the form and certain details of such bonds; pledging certain tax increment financing revenues to the payment of the principal of and interest on such bonds as the same become due; limiting payment of such bonds to the revenues specified herein; creating and establishing funds and accounts; delegating, authorizing and directing the finance director to exercise his independent discretion and judgment in determining and finalizing certain terms and provisions of such bonds not specified herein; taking other actions and making other covenants and agreements in connection with the foregoing; and related matters.

 

An ordinance to amend Chapter 20, Article I of the Omaha Municipal Code, entitled “In General,” by adding Section 20-9 to provide for a requirement that motor vehicles and motorcycles park or be stored on hard-surfaced driveway or paved pad adjacent to the driveway outside of a residence; to provide a penalty for violating such requirement.

AIR QUALITY CONTROL

NOTICE TO PUBLIC

 

Notice is given to the public according to Chapter 41 of the Omaha Municipal Code of the application of CERES to obtain a minor air emission construction permit for the industrial equipment manufacturing plant at 2505 N. 20th Street East, Omaha. The change in potential emissions, in tons, for this project will be: PM 24.9, PM10 20.8, PM2.5 4.6, NOx 4.6, SOx 0.1, VOC 49.3, CO 2.7, Ethyl Acrylate 1.6, Ethyl Benzene 2.0, Hexamethylene Diisocyanate 1.6, Toluene 2.2, Xylene 2.0, total HAPs 9.4 and CO2 equivalent 3,596.

No significant impact on air quality is expected from the operation of this facility. Douglas County is in attainment with air quality standards for the listed pollutants. Approval is recommended with the condition that any pollution control equipment that may be necessary for compliance with the City of Omaha or Nebraska Air Pollution Control Rules and Regulations will be installed within 180 days after notification by the City of noncompliance.

All information submitted by the applicant and the proposed approval by Air Quality Control are available for inspection by the public at the office of Omaha Air Quality Control from November 19, 2025 to December 19, 2025. Comments received during that period will be considered. During that period the applicant, or any interested person or group of persons, may request or petition the Control Officer for a public hearing, and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. The Control Officer may hold a public hearing if the comments, requests, or petitions raise legal, policy or discretionary questions and significant public interest exists with respect to the application.
